He had originally set it to expire on the 7th. It was extended at the next hearing. And last night that same judge said, you know what? The ATF is going to be enjoined from enforcing their new rule on members of the Gun owners of America, Gun Owners Foundation, the Virginia Citizens Defense League, the Tennessee Firearms Association, as well as, I gotta look, I'm just gonna get the states right, states of Texas, Louisiana, Mississippi, and Utah. So, I'm gonna show you a couple things that the judge said because I think it's key, especially if you wanna understand how this case is going to be destroyed for ATF. And then, Give you some more news because you do not have to live like in Tennessee or Virginia to be members of VCDL or TFA. You also don't need to live in Virginia to be a member of GOA as you know. And the ATF tried, they tried to get names of the members of these groups and wait to see what the judge said. So let's jump to this case. I'll show you a couple quick things. It's not going to be too long. And we'll show you what the judge said in closing. I will start with the opening paragraph from the judge in the cases, the state of Texas et al. versus ATF. And it's in the Northern District of Texas, the Amarillo Division, which has been very friendly to the Second Amendment. Judge said, before the court is plain as motion for a preliminary injunction. filed May 9, 2024. The defendants filed their response on May 14th. Having reviewed the briefing and relevant law, the court grants the motion. The defendants, ATF, are hereby enjoined from enforcing the regulations, definition of engaged in the business as a dealer in firearms, here and after called the final rule. published at 89 Federal Register 28-968 on April 19, 2024 to be codified at 27 CFR Part 278 against plaintiffs Texas, Louisiana, Mississippi, Utah, Jeffrey, Tormy, the Gun Owners of America, the Gun Owners Foundation, the Tennessee Firearms Association, and the Virginia Citizens Defense League pending the resolution of the lawsuit. The judges said the ATF cannot enforce this engage in the business crap against members of GOA, G.O.F., VCDL, TFA, as well as people in Texas, Utah, Mississippi, Louisiana, as well as the individual Jeffrey Tormey. Now, right off, you are going to be wondering, and rightfully so, why didn't the judge just do it nationally? Well, if you've been following this channel and all of the law that I talk about, especially the lawsuits regarding ATF and the challenges to their new rules all the time, a national injunction is strongly disfavored, which is why when these lawsuits happen, a bunch of people, a bunch of groups, a bunch of states joined together seeking their residents and their members to be covered under this injunction. It's just the way that the legal system works. It's strongly disfavored. In fact, the Supreme Court has said so as well. They strongly disfavored national injunctions. They want it to be relevant to the people who are actually involved in suing and fighting for whatever the charges are. So, with that said, I would like to see a national one as well, but I really think this is going to lead to a national destruction of the ATF rule on... You have to be an FFL to sell one gun. Check out what the judge said and you'll see why. Here's where ATF tried, tried to get the names of all these groups so that more people couldn't join and be covered by this after this lawsuit. The judge said the defendants next argue that the organizations must identify their members by name to have associational standing. The organizational plaintiffs cannot establish standing based on an unnamed member. But, defendants purported support in Summers v. Earth Island Institute did not concur in permissible reliance on anonymous or pseudonominous declarations to establish standing. So ATF is saying, look, Judge, if you're going to give coverage to all G.O.A. members, all G.O.F. members, all Tennessee Farms Association members, all Virginia Citizens Defense League members. We need to know who they are so that, you know, when we're jamming people up for this stuff, if they're one of those people, then we'll back off. And here's what the judge said to that. Moreover, the defendants, ATF, may be correct that some other circuits require a named member. CECF number 66 at 25 arguing that cases from the first, second, and sixth circuits establish that unnamed members are insufficient for associational standing. But this circuit does not. And the judge even said that the Supreme Court has said you don't have to have named people to have associational standing as well. So if you're a member, good. If you're a member, good. Then the judge said this, plaintiffs are substantially likely to prevail on their APA claim. That's the Administrative Procedure Act, which is how rules are made. which is where the ATF tries to make law even though they don't have the power to make law. Now, if you remember when I did the first video about ATF dropping this rule, the ATF is saying this is made possible because of the Bipartisan Safer Communities Act. That is the most recent gun control that was passed last year federally where a bunch of rhinos in each chamber joined forces with the anti-gun Democrats. Well, they're actually probably anti-gunners as well. to get this legislation passed. It did a lot of things. They claim it was a mental health bill, but when I covered this ad nauseam, it was obviously a blood-briar states into getting their own red flag. In fact, we'll have millions of dollars available for each state to do that, as well as tweak a few things and make it difficult for adults aged 18, 19, and 20 to get firearms because they created the extended background check for those folks, which is unconstitutional as well. So the ATF was leaning on the Bipartisan Safer Communities Act. Let's see what the judge said about that. As this is a question of statutory interpretation, the court begins with a text. Here, the final rule clashes with the text of the Bipartisan Safer Communities Act in at least three ways. First, it asserts that there is no minimum number of firearms to actually be sold to be engaged in the business for the purpose of the licensing requirement. In the rule, ATF said a single firearm transaction, or even a mere offer to engage in a transaction, may suffice. While selling large numbers of firearms, or engaging or offering to engage in frequent transactions, may be highly indicative of business activity. Neither the courts nor the department have recognized a set minimum number of firearms purchased or resold that triggers the licensing requirement. Similarly, there is no minimum number of transactions that determines whether a person is engaged in the business of dealing in firearms. Even a single firearm transaction or an offer to engage in a transaction when combined with other evidence may be sufficient to require a license. The judge continued, but the Bipartisan Safer Communities Act says otherwise. The term engaged in the business means As applied to a dealer in firearms, as defined in Section 921A11A, a person who devotes time, attention, and labor to dealing in firearms as a regular course of trade or business to predominantly earn a profit through the repetitive purchase and resale of firearms. But such term shall not include a person who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms. Defendant's proffered interpretation is severely undercut in section 921A21C's use of 1. Firearms in the plural. 2. The phrase regular course clearly contemplating a series of events. Three, repetitive, meaning more than once. And four, the section's exemption of sales, exchanges, or purchases in the plural. So too does Section 921A21C require the purchase and resale of firearms, a conjunctive requirement that flatly contradicts the defendant's assertion that there is no minimum threshold number of firearms purchased or sold that triggers the licensing requirement. Second, the final rule suggests that actual profit is not a requirement of the statute. It is only a predominant intent to earn a profit through the repetitive purchase and resale of firearms that is required. In other words, a person may repeatedly advertise and display firearms for sale and therefore demonstrate a predominant intent to earn a profit from repeatedly reselling their firearms purchased, but never actually find a buyer. But, Section A22 of the Bipartisan Safer Communities Act provides The term to predominantly earn a profit means that the intent underlying the sale or disposition of firearms is predominantly one of obtaining procuniary gain as opposed to other intents such as improving or liquidating a personal firearms collection, provided that proof of profit shall not be required as to a person who engages in the regular and repetitive purchase and disposition of firearms for criminal purposes or terrorism. The negative color is obvious. While proof of profit is not required for criminal purposes or terrorism, it is required for all other cases. Moreover, the mere fact that the word intent appears in the section does not necessitate or even suggest that intent is all that is required. Rather, the section's usage of intent serves to distinguish the type of intent contemplated, one of obtaining pecuniary gain. Action is needed too. Third, the final rule arbitrarily eviscerates Section 921A21C's safe harbor provision. That provision reads, the term engaged in the business shall not include a person who makes occasional sales exchanges or purchases of firearms for the enhancement of a personal collection or for a hobby or who sells all or part of his personal collection of firearms. 18USC 921A21C Nothing in the foregoing text suggests that the term personal collection does not include firearms accumulated primarily for personal protection, yet that is exactly what the final rule asserts. Nor can defendants' position be supported by its own interpretive policy of implementing terms common meaning. Yet defendants maintain their interpretation despite acknowledging that two-thirds of Americans report owning firearms primarily for defense or protection. thereby necessitating the absurdity that the statute's safe harbor provision provides no safe harbor at all for the majority of gun owners. Lastly, the final rule creates a set of presumptions indicating one, when a person has the intent to predominantly earn a profit and two, that someone is engaged in the business. But these presumptions are highly problematic for at least two reasons. First, they flip the statute on its head by requiring that firearm owners prove innocence rather than the government prove guilt. Second, several presumptions conflict with the statutory text. Two of them, for example, provide that a person is presumptively engaged in the business if he demonstrates a willingness and ability to purchase and resell firearms or purchases or resells firearms. As discussed Supra, a mere willingness is not enough. There must also be prohibited acts. C18 U.S.C. 921A 21C through the repetitive purchase and resale of firearms. Nor is purchasing or reselling sufficient. The statute provides a conjunctive. And here's the judge's conclusion. The plaintiff's motion for preliminary injunction is granted. Defendants are hereby enjoined from enforcing the regulations definition of engaging the business as a dealer in firearms. Published at 89 Federal Register 28968 on April 19, 2024. to be codified at 27 CFR Part 478 against all plaintiffs pending the resolution of this lawsuit. So ordered, last night, Judge Matthew J. Kaczmarek, U.S. District Court Judge. So again, I want to congratulate These states and groups involved, I want to thank them and I want to tell you all to support those who support you. These groups went out, spent money to sue the ATF to get this injunction and to first get those temporary restraining orders so that members of these groups and residents of these states can be free of ATF tyranny for this rule. He said that the ATF overextended themselves, that they don't have the ability to recreate law. did not find that adding a piece onto a semi-automatic firearm made the firearm meet the definition of a machine gun. Right. Because we do not see it that way. And of course the liberals all pulled their hair out and ran around with flaming butts over. Oh my God! Oh God! Oh God! Oh God! I know. Yeah, we see that's the thing. Again, If you've listened to any of the nonsense from these twits where they're saying, eh, I have a piece of plastic. If you remember, you know, the Petosniffer Meat puppet, you know, sounds like something from The Simpsons. This is plastic and it just makes a booming noise and gets bigger. It does more boom stuff, noisy stuff, hey, it's dangerous, oh god, it's dangerous. And basically it's like, the piece of plastic buttstock does nothing. I mean, supporting stock, I argued from the get go, I already knew where this was going. But let's look at the date, how many hours, how many days, how many months, how many years? time have we allowed all of these parasites to waste of ours? And this is the biggest problem I have across the board of this situation is it's great to the lawyers. They have been a fun time. They're raking in the bucks left and right. We have to scramble the bucks up and the regime works off our tax dollars taken from us at gunpoint so that they can brag up how they're coming after us again. And this is from the bureaucracy end. This is Not government necessarily, not legitimate government, although there's very little of anything in the regime that's legitimate anymore as far as the system goes. And what little is, they're usurping anyway, so it may have the title, but it doesn't have the mechanism or the function. And in fact, is a traitorous mechanism working for foreign operatives against the American people, and rightly should be shot out of this country yesterday. But American people, of course, will rotate on their thumbs. Vasily and agonize and you know again easier to suffer easier to suffer a hardship When somebody else is suffering because after all they're killing somebody else Then actually stepping up and getting rid of the threat which in reality is a mutual liberty interest threat Which is where we are right now with what they're doing. So and again, there's much more in the horizon. This is It's a already was a given. I will remind you as I've said a million times, this is 1977. They started this drivel when the crazy haired queers of $3 bill petals that were operating the Carter administration started the same ATF attack on flash hiders. and I've walked everybody through this over and over and over again and it was the same bullshit, a different day, the old story goes. But it was a matter of look, the AR-15 flash fighter in question, everybody had come out of the Vietnam War. And the CAR-15 psionics type reducer was not a suppressor, it was a reducer. In fact, it was more like with the Venturis and the way it was cut. It's more like a sound blaster forward like you see these new sound blaster cups that have been made to accentuate and direct the blast. In other words, if you were to the side, It's no different than, you know, because it's just a big bucket flash hider, cone flash hider is what it is, a barrel type, instead of a cone like you see on the carbine and on the grease gun. And by the way, also on the M250 caliber, if you pay attention on the, you know, the add-on fixture on the end of the barrel, you ever notice that? The cone type flash hider. The purpose behind that is to direct both a certain amount of the flash, but also a certain amount of the audio wave from each of the projectiles as they leave the tube because of the sonic crack that they create. And what happened is a bunch of guys who were all post-Vietnam, you know, post-Vietnam veterans loved, you know, always envied that a lot of guys were carrying those little CAR 15's. And I ain't talking with a 16 inch barrel with a little, little M16 flash hider on the end. Instead, they were the shorter barrel. There were four or five different lengths that they experimented with. Guys saw different models. And then they had this longer flash hutter because if you shorten the barrel on the AR-15, you have a lot of leftover burning powder that pops out in front of the gun. And in reality, when you pull the trigger, it's a shoot my ass, I'm here target, which nobody wants to talk about because it looks so cool that the short barrel. Well, because of this, government had to figure out in advance how to deal with that. And so what was called the submachine gun version of the AR-15, if you look at all the manuals, you will see what I'm talking about. And even the original instruction manuals on maintenance for the M16, it was not a submachine gun. It was a shorter light rifle, but they had to come up with a category for it. And the psionics reducers were hanging around people had wheeled them off guns brought them back I'm sure. That's not what the ATF was going after. They just simply wanted to go after gun owners. They figured out a way to do it by fabricating and lying their ass off. And so guys spent an ungodly amount of time in the court defending themselves because they would buy what was allowed to be sold over the counter. People would buy them, put them on their weapon, and the government would then go crazy town under Clinton, or forgive me, under Carter, G.M. O'Connor, Mr. Peanut, and they would abuse their authority. Now, what's interesting about this is another thing that came out about the same time, let's see if I can jog all you aficionados' memories. Maybe you'll remember, maybe you won't, probably not old enough. The CAR 15, especially as used by SOG and by the Navy SEALs during the later part of the war, did not have the psionics flash hider on the end of it. Instead, it had another Supra, and there were several other companies that made a silencer system that attached which actually was about the dimension of a standard grease gun, a little smaller, the two was, it had steps to it. It screwed into place on the end of the barrel, but it was again, it had to be a little bigger because it larger because it was accommodating a light rifle. Which in and of itself created some major issues with regard to trying to figure out how to quiet the gun down. Well, they did come up with a solution and they did issue it. So a lot of guys, and I know because I watched them do it myself, a lot of guys who were experienced and actually were in the seals or with one of the different warfare units later on, built in Chrysler or GM or, you know, take your pick, Ford's tool rooms, copies of the suppressor. But here's what they did. They cheated. So when the feds heard about these coming out, because they're as long as, say, from the end of the gas system out to a normal 16-inch barrel in length, right? If you think about the length here, well, what happened is, Colt started making 16-inch AR-15 carbine barrels. So the guys in the machine shops, what they did is they back engineered. They hollowed out a piece of metal aluminum. They sculpted it on the outside to look just like the silencer. But way up inside and accommodating a 16 inch barrel, it had the threaded point almost to the end of the barrel so you could thread this fake silencer on. Now you still, you had a 16 inch barrel, but now it looked like you had a little 11 point, what was it, 11.35 or 11.5. inch barrel with a tube on the end. And it monkey hockey, it really monkey pucked with the feds. My God, you should have seen, when they saw these at the gun show, they thought they were gonna have a boy time. I remember this like it was yesterday people cuz the guys knew exactly what they were doing when they built these. And it was a fascinating experience to watch the bat faggots go into brain fart. as these things showed up on the market. And they were not sold commercially, they were built privately. But they were exact replicas because the guys who built them in many cases were the people who'd use them. So they knew exactly what it was that they were reproducing an image, but they were not in any way, shape or form a restricted item. But the Batfaggot sent out notices, they came up with all kinds of hairy eyeball plans for what they were gonna do, and then they fell flat on their face. And it was very frustrating for the turds. So if you think this is new with regard to the turds and what the turds do and what kind of filth you're dealing with, guys, we've seen all of this BS before. That's why I'm saying this is sit and spend garbage. You should get tired of it after a while. America, we need to just put its ass out of here. It's not like, well, we need to step them back. No, they need to be gone. They just need, they're literally, all they are is a machine whose purpose is to create an unjust taking of America's time, a wasting of our resources, a wasting of people's lives. Like I said, lawyers love it. This is fantastic for the lawyers. Boy, they had a great time. I'm sure they did. Bank accounts are much thicker now because of it. But the fact of the matter is that we should be aiming towards completely putting their operation out of business, period. So again, these things you see over the years and the flash shatters were the first, don't worry. They went back and forth on the folding stocks. They went back and forth, and my job gave everybody's memory from the late 70s and early 80s. Oh, they went after the folding stocks. Oh, they went after the length, even a 16-inch barrel. Some of them have some really neat options that we don't have with Discord or with gilded and I like to go to because there's some options there that we still haven't utilized with Gilded that we could but looking around at some of the other ones you guys have have Sent my way campfire looks promising I don't know if we could use story prompt although that's another one that looks interesting for broadcasters being able to like set up a series of streaming content on that system is interesting. I don't know if we could do it. It looks like it's set up for video streaming though, not for audio streaming. I don't know if we would be able to find a way to utilize that with our audio stream. We might have to stream video with it like some image or something else to get that to work if we go the way of Story Prompt. There's also Slack, which looks like a really primitive version of Gilded slash Discord. All the basic elements are there though, which is all we really need for chat communications. Chatty is another one. Looks a little more business oriented. More options in that area, so it looks... Looks like it could be doable. I've got a problem with like the triple chat streams going on one one feet at once though myself, you know, it's easier to just track the one Skype we're not going back to Skype Microsoft took over Skype Skype frag Dan, you know since tracking is an issue that some of the people brought up with the issue with roadblocks taking over, you know, tracking here for ads and everything. I'm going to remind people again, that is going to be a problem you're going to have come across the board. More so, especially when you look at things like Skype, which is run by Microsoft, or when you look at Microsoft Teams, which is run by Microsoft. Telegram is one of the ones you guys mentioned. That's come up settled on. Also, Telegraph, Telegraph and Telegram. Both of those look interesting, could easily be set up, I'm sure. Let's see, Steam Chat, that's a gaming service again, though that one's pretty big, popular with gamers. Let's see, Flock is another one that was recommended. I'm not familiar with that system at all. I haven't even looked at it yet, but it looks similar to Campfire. Then we got talks which again it looks like another clone of campfire with some fewer features and Reddit of course that's another big one. I don't know how much Tracking goes on with reddit. I'm sure there's a lot there because they do a lot of marketing and advertising Let's see There's one called signal which is kind of more like Skype login and be able to make voice over IP calls Matter most again, it's a simpler looks like discord clone, but not being used for gaming more like used for game meetings and whatnot with businesses Let's see Whatsapp. I'm not familiar with I Mean I know other people that use whatsapp, but I've never used it myself Let's see. We also had Let me go down here. Lark, which again looks like it's more business oriented, which would be fine. You guys sent me a lot of them here, so there's a lot to go through. Rocket again. Oh wait, no, not Rocket. WhatsApp, WhatsApp. Rocket's another one. Rocket Chat, which again is, it looks like a Discord clone with simpler features and tie into your cell phone, smart phone. Most of these have tie-ins to smart devices now. Which anything in the odds of the smart device you tie in, it's tracking you anyway from your phone. Lots of interesting programs that were there before. Microsoft Teams, again, it's Microsoft. You're going to be dealing with Microsoft. Google Chat. We mentioned that before, Spike and the guys were using, I think, Google Chat and another Google thing with Indiana Freedom Talk radio while he was live. They were trying to get me on that, but, you know, it's Google Chat. It's Google. And you want, if you want to minimize, you know, what's being tracked on you and everything, Google is not the way to go. Let's see, we already covered Chatty. So you guys sent me like, some of these are like doubled up with the others, because I'm looking through the emails right now, what you guys sent in. Let's see. I haven't used TeamSpeak in a long time. I don't know if they've changed that out. But TeamSpeak I thought was just a audio chat service back when we used it with World of Warcraft. That's all it was, was I don't know if they've changed anything over there. If we could use TeamSpeak like what we're using, or Gilded, or like we used our Discord for. I don't know if we could do that with TeamSpeak. I'll have to go check that out and see what changes they have made to it, if any, that would be significant where we could use it in that way. If that is the case, I'd probably have an account over there that I could reactivate and get things going. Let's see, another one, troop messenger, again, that's more corporate. I think that's a paid-for service, too. Let's see, Chatty again, we already covered that one. Hatespace, so there's, again, like I said, there's a lot, flak, mumble, flock. Riot, which looks like a Discord clone, but then, Riot's an interesting name for a chat service. Hangouts Chat, Microsoft Teams again, let's see, Steam Chat, Raid Call, R-A-I-D-C-A-L-L. Looks like other broadcasters are using this as well, so that might be one to look at. We might do something with, of course, Referral to Skype again. No, I don't want to go back to using Skype. It got rekt by Microsoft. Ventrilo, if you've used Ventrilo before, I don't think Ventrilo's changed enough. I mean, if we were using it for like a voice chat system only, I think it would be good for that. But yeah, it's for voice. I don't believe, again, that has the option to do what you can do with Discord or Guilded. It looks like that's a phone app thing only. I'm not seeing anything where... Let's see. We have another simple messaging app like Discord that lets you make free secure calls, messages. Yeah. Riot again. Riot's been suggested a couple of times. We might be able to do, we might be able to use that one. Again, it looks like a simple version of Discord slash gilded. And wire. Supreme Court overturns bump stock ban in 6-3 ruling. So we're going to play that at 16 minutes and 42 seconds long. We're going to play it in its entirety. So before I jump too far down that rabbit hole let me know if you can see and hear. because the United States Supreme Court has just again sided with the Second Amendment and destroyed another unconstitutional ATF regulation that they tried to go for law. Thank you very much for the information that we are live. You can hear me, see me? Let's do this. This decision just came down. I want to first thank my friend, my personal friend and hero, Steven Williford, the barefoot defender. Sutherland Springs, Texas shooting. If you don't know about Steven, you need to know about Steven. He called me. I was out helping the wife in the garage. Let's go. Supreme Court just came down with the decision that we've been waiting for in the Cargill case. The Supreme Court just ruled 6-3 and wait till you hear what they said. This is phenomenal. Let's get into it. I'm reading this for the first time myself. This was argued on February 28, 2024, through June, and was decided today. The National Firearms Act of 1934 defines a machine gun as any weapon which shoots is designed to shoot or can be readily restored to shoot automatically more than one shot without manual reloading by a single function of the trigger. With a machine gun, a shooter can fire multiple times or even continuously by engaging the trigger only once. This capability distinguishes a machine gun from a semi-automatic firearm. With a semi-automatic firearm, the shooter can only fire one time by engaging the trigger. Using a technique called bump firing, shooters can fire semi-automatic firearms at rates approaching those of some machine guns. a shooter who bump fires a rifle uses the firearms recoil to help rapidly manipulate the trigger. Although bump firing does not require any additional equipment, a bump stock is an accessory designed to make the technique easier. A bump stock does not alter the basic mechanics of bump firing. and the trigger still must be released and re-engaged to fire each additional shot. 6-3 this is. For many years the Bureau of Alcohol, Tobacco, Firearms and Explosives consistently took the position that semi-automatic rifles equipped with bump stocks were not machine guns under Section 5845 Bravo. ATF abruptly changed course when a gunman using a semi-automatic rifle equipped with bump stocks fired hundreds of rounds into a crowd in Las Vegas, Nevada, killing 58 people and wounding over 500 more. ATF subsequently proposed a rule that would repudiate its previous guidance and amend its regulations to clarify that bump stocks are machine guns. ATF's rule ordered owners of bump stocks either to destroy or surrender them to the ATF to avoid criminal prosecution. And in case he's watching, I'm not paying attention to the chat at the moment, Michael Cargill, thank you brother, thank you for pushing forward when others might not have been able to. Michael Cargill surrendered two bump stocks to ATF under protest, then filed a suit to challenge the rule under the Administrative Procedure Act. As relevant, Cargill alleged that ATF lacked statutory authority to promulgate the rule because bump stocks are not machine guns as defined in Section 5845 Bravo. After a bench trial, the district court entered judgment for the ATF. The Fifth Circuit initially affirmed but reversed after hearing on Bonk. A majority agreed that Section 5845 Bravo is ambiguous as to whether a semi-automatic rifle equipped with a bump stock fits the statutory definition of a machine gun and resolve that ambiguity in Cargill's favor. Held, the ATF exceeded its statutory authority by issuing a rule that classifies a bump stock as a machine gun under 5845 B Bravo. Guys, I don't know if you're paying attention. This is the third ruling against ATF in like four days I told you was gonna get good and the fruit is starting to be bared bared born You know what I mean? All right, hey A semi-automatic rifle equipped with a bump stock is not a machine gun as defined by 5845B because 1. it cannot fire more than one shot by a single function of the trigger and 2. even if it could, it would not do so automatically ATF therefore exceeded its statutory authority by issuing a rule that classifies bump stocks as machine guns I need you all to do me a favor. You just hit like and hopefully subscribe. Alright, B. A semi-automatic rifle equipped with a bump stock does not fire more than one shot by a single function of a trigger. The phrase function of the trigger refers to the mode of action by which the trigger activates the firing mechanism. No one disputes that a semi-automatic rifle without a bump stock is not a machine gun because a shooter must release and reset the trigger between every shot. And any subsequent shot fired after the trigger has been released and reset is the result of a separate and distinct function of the trigger. nothing changes when a semi-automatic rifle is equipped with a bump stock. Between every shot, the shooter must release the pressure from the trigger and allow it to reset before re-engaging the trigger for another shot. A bump stock merely reduces the amount of time that elapses between separate functions of the trigger. Oh boy, they were listening to what all these gun folks were saying. This is awesome. ATF argues that a shooter using a bump stock must pull the trigger only one time to initiate a bump firing sequence of multiple shots. This initial trigger pull sets off a sequence fire, recoil, bump, fire that allows the weapon to continue firing without additional physical manipulation of the trigger by the shooter. This argument rests on the mistaken premise that there is a difference between the shooter flexing his finger to pull the trigger and pushing the forearm forward to bump the trigger against his stationary trigger. Moreover, ATF's position is logically inconsistent because its reasoning would also mean that a semi-automatic rifle without a bump stock is capable of firing more than one shot by a single function of the trigger. Yet, ATF agrees that this is not the case. ATF's argument is thus at odds with itself. See, even if a semi-automatic rifle with a bump stock could fire more than one shot by a single function of the trigger it would not do so automatically section fifty-eight forty-five b spits specifies the precise action that must automatically cause a weapon to fire more than one shot a single function of the trigger If something more than a single function of the trigger is required to fire multiple shots, the weapon does not satisfy the statutory definition. Firing multiple shots using a semi-automatic rifle with a bump stock requires more than a single function of the trigger. A shooter must maintain forward pressure of the rifle's front grip with his non-trigger hand. Without this ongoing manual input, A semi-automatic rifle with a bump stock will not fire multiple shots. ATF counters that machine guns also require continuous manual input from a shooter. The shooter must both engage the trigger and keep it pressed down to continue shooting. ATF argues there is no meaningful difference between holding down the trigger of a traditional machine gun and maintaining forward pressure on the front grip of a semi-automatic rifle with a bump stock. This argument ignores that Congress defined a machine gun by what happens automatically by a single function of the trigger. Simply pressing and holding the trigger down on a fully automatic rifle is not manual input in addition to the trigger's function. By contrast, pushing forward on the front grip of a semi-automatic rifle equipped with a bump stock is not part of functioning the trigger. And they are slaying the ATF. They're crushing them. This is phenomenal. Another landmark decision here. Moreover, a semi-automatic rifle with a bump stock is indistinguishable from the Ithaca Model 37 shotgun. A weapon the ATF concedes cannot fire multiple shots automatically. ATF responds that the shooter is less physically involved with operating a bump stock equipped rifle than operating a Model 37. It explains that once a shooter pulls the rifle's trigger a single time, the bump stock harnesses the recoil, the firearm's recoil energy and continuous back and forth cycle that adopts the shooter, that allows the shooter to contain, to continue firing. But, even if one aspect of a weapon's operation could be seen as automatic, that would not mean the weapon shoots automatically more than one shot by a single function of the trigger, automatically. That's the key emphasis. and single function of a trigger. B, I'm sorry, D, Delta, abandoning the text. ATF attempts to shore up its position by relying on the presumption against ineffectiveness. That presumption, thank you for the super chats, y'all. I'm sorry, I missed a few of them, and I'm sorry, just whacked my microphone. That presumption weighs against interpretations of a statute that would render the law in a great measure and enable offenders to elude its provisions in the most easy manner. In ATF's view, Congress restricted machine guns because they eliminate the manual movements that a shooter would otherwise need to make an order to fire continuously at a high rate of fire, as bump stocks do. So, ATF reasons, concluding that bump stocks are lawful simply because the trigger moves back and forth, would exalt artifice above reality and enable evasion of the Federal Machine Gun Ban. The presumption against ineffectiveness cannot do the work the ATF asks it to. Interpreting 5845 Bravo to exclude semi-automatic rifles equipped with bump stocks comes nowhere close to making the statute useless. And this was affirmed by... See, the opinion was delivered by Justice Clarence Thomas, who is single-handedly destroying ATCA lately, in which Chief Justice Roberts, Alito, Gorsuch, Kavanaugh, and Barrett joined. Justice Alito also filed his own concurring opinion, and who do you think came against it? The Wackos, Sotomayor, filed the dissenting opinion in which Kagan and Jackson joined. Now, I just read you the opening. There's another four to 39 pages that I still have to read. But the most important thing is, is the United States Supreme Court has just ruled 6-3 that ATF's bump stock ban is unconstitutional. And that's great. ATF, you're getting your teeth kicked in for your unconstitutional BS. And it's phenomenal. Guys and gals. This is great. Michael Cargill, I don't have a hat on. It's always kind of bothered me that these people who are the heads of regiments and the heads of the military itself are basically a bunch of kind of larpers. One of the Royal Family's many jobs is kind of as the marketing wing for various arms firms, for your BAEs and your Lockheeds and your Ravians. And you see them cutting around, sometimes in military uniforms, sometimes in local dress, this weird hedonistic cosplay. What goes on behind closed doors? but they're really into going around, hanging out with dictators, putting on Arab headscarves and Arab dress, for example, snuggling up to these people. But underpinning that, they're trying to flog weapons, flog missiles, flog all kinds of arms equipment to these countries. And that has long been their role. That's the case for Charles. It's also the case for Andrew. The true nature of monarchy is kind of concealed in a way which in those countries it isn't. It's raw power and absolutely dictatorial, whereas in Britain we have this kind of veil, this idea of a constitutional monarchy. with some limits and they can't do the things that they would perhaps they used to be able to do or perhaps would want to because we know some of these people are pretty unhinged but it's interesting when you look at the parallels our green fingered well branded king is actually best pals with some of the most brutal authoritarian tyrannical monarchs in the world there is a proud culture of dissent against monarchy in culture, in our culture and a good example of that is the Monty Python railing against the idea of monarchy. The Sex Pistols who did a particular great song about the Queen. I think it's waned and I think that's an I do wonder if it's because so much of culture, so much of music, so much of the arts, it's becoming increasingly middle and upper class field and it's much nearer to power. A lot of that anti-monarchist stuff, particularly with the Sex Pistols, came from an angry bottom-up working class, a place of descent and out range and there's an urge to mock power which I think is one of the really redeeming things about the British that we do and always have to somebody we mocked power we've lampooned kings taken a piss out of Queens as a long tradition of that but I feel it's probably receded where are the artists who will mock power challenging the common sense of society Not all King Charles's have had an easy run in this country. Years ago, decades ago now, this is year 2024, this happened back in the early 90s. It was an agreement under George Herbert Walker Bush and then extended by Bill Clinton and Hillary the Hutt to provide massive federal funding to expand the prison systems of America. So as to create a stand by detention camp system across the United States, which is exactly what they did. Now, every state, and you can do this by using Google, you can find any prison that's listed in the system. And in the process of observing the prison system from the Skynet position, in other words from above, You can actually observe and see the format for all of the prison pods that were created as part of the quote unquote new design. Well, who came up with this new design? Well, the feds did. What was it? It was an expansion, as I said a moment ago, it was an expansion of the Civil Defense slash then FEMA detention camp system. putting on standby virtually hundreds of level one secure concentration camp configured pods of prison buildings. Now, every state has them, your state is not separate. There isn't a state that didn't whore out to this project. There is not a state that does not have These prison camps slash detention camp pods in place, they're level one unsecure, no, forgive me, level one secure, no, not unsecure. These level one secure sites are usually with groups of five buildings per pod. Each is a block, they are a pole barn type construction. They were done as a hasty construction, but the format for both how the cells are established. how the blocks are established, where the bathrooms are, where the public areas are for mingling amongst the prisoners if it's allowed, is identical from state to state. Contractors varied on this. So it's not quite the same, but as close as could be to the old World War I and World War II barracks program, except in this case, it was to build a massive concentration camp slash detention camp network across the United States, which it did. All of your states have them. Now some states backed off from the program, Ohio being one of the first, amazingly enough. And in fact, Michigan and Ohio were a parallel example of this program on steroids. The state of Michigan originally only had three prison pods. for the whole of the Upper and Lower Peninsula. This was Jackson Prison Complex, the Ionia Prison Complex, and Marquette, Michigan, located in the Upper Peninsula, about as dungeon-esque and about as remote as you could get. In fact, the old prison looks like a classic medieval castle if you've ever seen it. That's the behind the wall part. We now have 54 prisons in Michigan. Now Ohio had a comparable number and had a comparable prison population, which by the way, the reason that they promoted that was the profit making mechanism in addition to the federal funding received for the concentration camp program. Now, while this was going on, and we've mapped this out 30 years ago, Walmart got into a contract. cooperative operations in the event of mobilization of the FEMA system of the detention camp, which now would be under Homeland Suk Ureide. Homeland Suk Ureide is a registered agent of a foreign power operating from outside the United States against the American population. They have taken custody of most of the alphabet soup agencies as the foreign operative slash the changeling. They're a direct copy of the interior police of the communist KGB under Jewish communist Russia, when it was Jewish communist Russia. And the entire package, of course, was integrated or segued into the preparation for the mobilization of both the detention camp grid that was being maintained by the states. But then could be taken by the Fed at its discretion given the state specific orders to compress its population and surrender the sites to the military slash, I'm sorry, homeland sucky righty. Now on military component, here in Michigan we have a number of air bases from the Cold War era that rather than being shut down, were signed over sideways under the same civilian detention camp agreement to different states. Now, each of these has to be maintained and in fact has a custodial ship monitoring system by the US Air Force to ensure that the facilities are maintained to a particular specification. And in the event that the FEMA slash the Homeland Security detention camp grid were lit up for housing the American population using the illegal aliens as secret police or as cannon fodder slash bulkers for say running the detention camps and also for rounding up people. These complexes would be surrendered immediately with no questions asked. to the Fed and to the Homeland Security slash globalist mechanism that is in place. As I've said before with Walmart, now Walmart is pretty straightforward. They run on wheels. I want you to go and look at a Walmart. Everything's mobile. Walmart can be cleared out probably in three hours. You bring a column of trucks in, everybody knows what their job is, nobody's stupid, everybody's given one task. If you do this and you train a team, They could go from complex to complex and actually tighten their schedule up so that they can reduce the turnaround time to convert the Walmarts into area pre-sort or sorting facilities for Homeland Security against the American population. And specifically to try and disarm the population and to destroy the Constitution and Bill of Rights. If you'll notice with each one of the Walmart complexes, they have a garden center. Have you looked at the garden center? The garden center is like a yard in a prison. And if they operate as they would as a medium or low detention facility completely enclosed, you put fences on the inside, you prefabricate fencing, all of that bolts together and you have a cage system for incarceration inside. You got proper volume, you already have cameras for monitoring. You even leave the mess hall slash the deli area in place. And you have a food processing site for bringing the prisoners in, lining them up, putting them to the chow tables. All of those are on wheels. You ever see how a chow hall is set up? Folding tables, just like you have in the school cafeterias, the whole nine yards. It all gets rolled in, it all gets dropped, it can be turned around, easy to clean up, etc, etc. The garden area becomes the yard for out time. It's already set up to be totally locked down. Look at the bars, look at the size of the area, take a look at how it's secured. You'll see what I'm talking about. External security and perimeter security is the same as the internal caging slash prison area. That can be done with mobility screening and mobility fencing that is bolted into place. Razor wire is used for standoff or for top off for the wall fence wall. And a perimeter security could be made, could be doubled up or it could be left as single tier depending upon what kind of manpower. In this case, illegal aliens given uniforms, given weapons and a minimal amount of training. kept in their indigenous blocks. In other words, if you have Central American secret police that you wanna use, keep them all together. Your linguist only has to know one language, your Chinese secret police or your Chinese execution units. Because remember, all Chinese police are executioners. But if you just go to the website, You can find the coupons and stuff over there and other deals that they have going on because there's just too much to list I mean some things are good deals summer, okay There is a website called Harbor Freight coupon database I think its name of it and you can look up specific items and kind of see it keeps a log of the prices so you can kind of track when if it's you know more expensive items you can track and see win that item around roughly what part of the year that it drops to the lowest price over the year and you can see the last, I don't know, five, six years, depending on how long they've had that item in their inventory. But you can, it should be on there, most things, most things are on there, big majority of stuff's on there, so you can kind of see a record of the prices and what they've been at. with coupons and whatnot, you can click on it and it'll actually show you the coupon that they had or whatever. So you can see at least the most recent lowest price and when that was available so you can decide whether you need to, if you want to hold off for another couple months because they'll have another sale in a month or two and then you can probably get whatever you're looking for at that price. And like I said, I'm talking about Harbor Freight. Now, I have brought up the Gordon multi-tool, which is comparable to the Leatherman Wave tool. It's normally 40 bucks, so if you use the 15% coupon, you'll save five bucks, so you get it for $35. But a lot of YouTubers are doing reviews on this. multi-tool and stuff and compare it and it's getting halfway decent reviews and stuff. And it's at least equally close to a Leatherman for say, if you want cheap entry-level Leatherman, that's not a Leatherman, but definitely something you can put in your bag and not cry about it if you do lose it because it's only 40 bucks or if you use the coupon $35. I'm sure later this year, Mark, I'm sure they'll mark that down. They'll have a special deal because they've done that with other items where they'll have it marked half, at least almost half off. So they've done that with other like flashlights and stuff like that that are normally $40 and they'll have it down to 20 bucks and it's either a one day deal or whatever. So just have to kind of follow some YouTubers that cover Harbor Freight a lot. And just kind of keep checking and and I said you can find those those deals when they post them instead of Really good cheap stuff. They do have solar panels over their mark. They have the charge controllers Some of them come with it or separate they have we can buy the panels And they even have I think a smaller foldable panel. That's like 10 watts, I believe I don't know what the price is on the right. I think $30, maybe the lowest, but that's very small wattage, but they have really big panels and stuff. And I think they even got some newer ones. Recently, Mark, they just added some newer ones, I believe. A lot bigger panels, so definitely anybody interested in that, check that out. As a matter of fact, again, remember, Tarver Freight, for a lot of you out there listening, A lot of the items that were brought up aren't the top end, they're Pontiacs. Okay, think about it that way. GM always made Pontiac. I wanted SS Chevelle. Yeah, but I couldn't afford one. But you know what? On the same frame, you could buy a Biscayne. What was a Biscayne? It was as bargain basement as Chevy as you could ask for. And then you do that it is up because you went to the junkyard and torque, torque off the front end or the trim and then added some decals in the paint shop or from the from the parts store used to have a whole decal book. And I have an SS Chevelle. No, you don't the serial numbers don't matter. Yeah, but nobody would know back then nobody cared. It looks like a Chevelle. It looks cool. In this case, it functions well enough and it gets you on the page. And let me point out when you buy these items, you're buying these items to get something into the inventory that works. It's not the upper end. But when you do finally save money and you get that, let's say that Gerber you always wanted, you know what you do with the other one? It goes into your backup kit. Or it goes into that cash you're gonna bury because you're not gonna cry about burying a bunch of equipment that is good, but second line and it's paid for. This is how you build up your defense structure. This is how locally you can afford to go deep in terms of supply and support. And again, is it the most expensive? Most no, not at all, not anywhere near, but it'll get the job done. Another thing about Gerber tools are like multi any other multi tool. Okay? It doesn't do anything fast, but it does it. Even a cheapy one. It doesn't do anything fast, but it does something. And if I got a whole bunch of guys and gals standing there and they've all got a tool and everybody works at something snip snip or twist twist or turn turn turn. And I do it times a multiple number of people who are using their brains. You'd be surprised how quickly something can be accomplished. Something can be done, finished and out of the way. And that's one of the reasons everybody needs to be carrying one. Go ahead, jump in there. Also, I remembered on that Gordon multi-school, since it's like the Leatherman wave, it has a bit driver. I mean, obviously it's not ratcheting, but it's very small, but there is a company out there that makes an extension. It's about a three inch extension that slides into the little slot for the Bitdriver and will actually make it a lot easier to use the Bitdriver on the tool that it's a small thing. I think it's under 20 bucks. You can find it on Amazon. I think it's like $13, $14. If you look up Leatherman Wave Bit Driver extension or something like that, you can find that and add that to your kit so you can use the different little Phillips bits and everything else you can use the little bits and it has an extension so it makes it easier so it's not light next to the to your multi-tool and it's hard to manipulate if it's in a tight spot or whatever. Yeah almost like a screwdriver. Exactly. So it helps out but it's an easy cheap investment and people have tested it and it does work on the gluten multi-tool so it's an exact crossover will fit the little slot. on the good multi-tool, so definitely a good extra investment if you do go this way and then have that. And by the way, always check Harbor Freight. They do have a number of other deals and special sometimes unadvertised in-house deals, not many because they are a big, big China Sport change store. We know what they are. The important thing is we're gonna take what's provided and use it to kill Ching Li when the time comes. What we're doing is preparing to deal with the problem our enemy has imported. Our enemy in Washington who hates America and especially hates Americans. So, for all of you, we need to be prepared to go to war, and go to war effectively, that means we need all the tools in the toolbox. And this is one of the items slash solutions that you need to have in hand when the time comes. It's pretty straightforward, too, so this is difficult to understand. One thing about the universal tools, when they first came out, guys, they were really, really simple. Gerber, if you look at the, I don't know, nobody's ever done a history of this. Actually, I can't say that. Blade collectors, knife collectors, have a good working knowledge and a good understanding of the history of things when they've come out because needless to say, the older it is, the more valuable it is now. So they know the market, by the way. But when they first came out, they only did six things. And by the way, as I've said many times, take that tool, any of those tools put a four-way screwdriver, something that you mentioned was also in the, remember was in the last ad for a tractor, oh come on, Harbor Freight. And what's interesting about that is that again, those four-way screwdrivers as drivers between that and a multi-tool, and in fact I used to carry, as I've pointed out many times, I used to carry a Klein In fact, I was trying to remember which one it was. It's the Klein because the Klein had a problem. When they were so busy competing to make these multi-tools, they were trying to add more and more widgets and items to make them look intricate. Well, one of the things that Klein did is they attached a, which was a good idea, they put a little scale on the side of the tool, which in this case was an electrician's type of Klein multi-tool. So it had a pair of needle-nose, it had a bunch of other fine tools. And it was really well cut, really, I liked it a lot. The problem was, they didn't think and they scored the little scale that had inches on the side with eighth inch, quarter inch, whatever. Well, they scored the cuts so deep that it compromised the tension of the body and they snapped. The tool would snap where the cut for one of the inch marks, one of the quarter inch marks was located. And I had it happen on both tools. Now, the cool thing is it was under warranty, so when it failed, it failed. But it was something they didn't realize. They were in a hurry. It was competition. Everybody was competing with everybody in this stuff. And this is something that happened. It was fixed. Eventually, they settled the problem. They figured out what to do right. It wasn't hard. Just don't cut so deep. It was softer, but you could read it, but it just wasn't going to. Now, it wasn't going to break the tool. So that kind of thing can happen. It's something that I'm not worried about now. With the cheapies, probably not at all. To be quite honest, it's most likely that they're going to be minimizing, and they usually do. And remember, if you don't cut it as deep, the tool doesn't wear as much. Oh, that's right. That's why they wouldn't do worry about that. And it's true. That's actually one of the considerations is, you know, if you minimize the tool usage, you maximize its use to the end. And so again, just things to think about, things to remember. There's been a lot of cool stuff that's, you know, been out there. It's still out there and it is highly useful and multi tools are one of them. But those four-way screwdrivers, remember the way they're set up, there are two straight blades, two different sizes on the straight blade pullout. That of course goes into a hex socket. Now the other end of the shaft has the Phillips, but it has a different size hex for the size of the shaft that the Phillips are on. And the reason they did this is because it covers two types of slot, two types of Phillips, and two types of nuts. And I believe it was 516s and 3 8s, but you can kick me into the microphone on that, I may be off by one. I don't think I'll care. We'll figure it out. You'll figure it out if you had it anyway, right? But the neat thing is, is that it does offer you that many more options as a tool carried in the field. So it is a useful tool. Militarily, just as a heads up, it used to be that tools were special issue items. And what do I mean by that? Well, you issued out, if you had a unit going into the field, You literally signed out a pair of wire cutters. Let's say you needed to infiltrate an area. You knew you were going to operate in a particular way. Military's traditionally were in a retentive about resources, obviously, some more than others. But you signed out wire cutters and you issued them out to specific people who were designated as part of your SOP and it's also part of your orders, your operational order for the activity and the planning of the activity. So, wire cutters would specifically be issued out. Well, it's like I said earlier, if you have everybody carrying something that's the equivalent to a decent wire cutter, and most of the Leatherman have a pretty decent metal or gene over the quality of the steel is decent, you actually have everybody carrying a halfway decent little set of wire cutters with them. Now, they aren't going to handle heavier gauge or better quality metal as far as the wiring goes. So, you'd still probably carry or issue out a number of either tiny bolt cutters or wire cutters that are military spec military issue. Government used to do that though, and it was very much a control item. Today, we have the benefit of all CNC, all the other things that have come about, we're kind of resource rich. So now, we need to take advantage of that. And again, tools in the field, guys, you're not gonna be coming out right away. You're not going back home to pick something up. I can't emphasize that enough. We're going to war in 24. And that means that what you have is all you have. Whatever you're carrying, that's what you got. So proper planning, preventing piss poor performance, you're just gonna make sure you have what you need with you and a multi-tool and other utility tools, not the least of which is also everybody carrying or at least every other person carrying. a cut off saw of some kind. There's all kinds of fold up different types of utility saws available. A variety would be a good idea. And I'm gonna say this again, everyone should in a heavy infantry configuration, all of you should be carrying an E tool. Contrary to the bullshit BS that everybody
