There should be a number of different follow up articles. There was supposedly confusion, there really isn't any confusion on this.
Some people that are in the firearm circles are trying to figure out how they can desperately do damage control because... Well, a lot of them were saying, here we go, this had never happened. A case that challenged the legality of not only the 4473 in ways, but also does one have a constitutional right to lie on said 4473?
Yeah, this one is an interesting case because we've seen a lot of individual scenarios challenging the 4473 and the constitutionality of some of the questions on that form.

And let's get into this video about challenges brought to the 4473 and the constitutionality of said process. This is the case I am going to be talking about today. And this was brought in the Seventh Circuit, U.S. Court of Appeals. And this is in front of a three-judge panel. It's the United States of America versus John Holden.
The long and the short of the center of the case, the epicenter of it, is that John Holden, in August of 2021, went to go buy a firearm. As he filled out that form, he checked off no on the question that asks if you're under indictment
for anything. And that's where this challenge comes in. Holden was accused of battery on a public safety official, which is, and he chose...
know on that because he wasn't indicted for it. Well then in August of 2022, Holden pleaded guilty to violating 18 U.S.C. 922A6, which makes it a crime to knowingly make false statements or fictitious oral or written statements intended or likely to deceive an importer, manufacturer, dealer, or collector with respect to any fact material to the lawfulness of the sale
or other disposition of a firearm or ammunition under the provisions of this chapter. He then sought to withdraw the plea in order to contend that 18 U.S.C. 922 N, which makes it a crime to purchase or receive a firearm while under indictment for a felony, violates the Second Amendment as understood in the New York State Rifle and Pistol Association, Inc. v. Bruin. The district court granted his motion and dismissed the indictment.
ruling that 922N is invalid. The United States has appealed, and that's how we get to where we are today. Now, Holden had been charged by information while 922N uses the word, quote, indictment...
The parties and the district court treat these words as equivalent, and we do so too. The main problem with the district court's approach was that Holden wasn't charged with violating 922N. He was charged with basically lying to the firearms dealer in violation of 922A6. So this case, the judges, again, a three-judge panel, they discuss how the form 4473 has questions on it.
that may or may not pass a full muster with the Supreme Court related to the constitutionality of the questions. We've seen a couple of those questions be ruled unconstitutional at district levels already. But this three-judge panel says that there hasn't been an appellate court yet or the Supreme Court that has said that these are, in fact, unconstitutional. So while they are still, I guess, negotiating
The constitutionality of this, the legal fights continue, the judges are forced to rule as things stand now. So what the judges said, and I'll link to the decision, it's a four and a half page read really, but what they say in this is that
You might not like a question on there. You, your choice as an American is to not answer that question, which could affect your ability to purchase that firearm, obviously. But you don't have the right to lie on the 4473 if you disagree with the question. They go into saying, you know, why these questions are there, and if you're under indictment for something and you check yes, then it basically brings a second check, a second peek.
to see what you're under indictment for. They used examples of obviously domestic abusers, illegal aliens, and stuff like that. So in fact the judges were like, oh, this is cool because...
They also said that the federal government has the right to ask for identifying information such as names or social security numbers from people looking to buy firearms and obviously they say that they have the right the government does to keep guns out of the hands of violent people, violent criminals. So this
I believe is one of many cases. We've already had one discussing the marijuana usage questions. We've already had one discussing people who are federally prohibited because they were under indictment of a non-violent crime. People who are domestic abusers who have just had a restraining order on them but weren't found.
guilty, it was just a technicality. There's all kinds of challenges to the 4473 and I think this is another one that is going to probably bring a change to the 4473. There are things that people are banned from owning firearms for in this country now which people were never banned for
before. So I do think that you are seeing the unraveling, the fracturing of the gun control pillars in this country thanks to the Bruin decision, a big part in the Bruin decision. And as these challenges continue...
You're going to see I think the Supreme Court being tasked with addressing this now this case right now I don't know if it's going to be appealed Will they appeal on bonk which means the entire 7th Circuit? Will they appeal directly to the Supreme Court or will they just let it sit? That remains to be seen still this decision came out
I believe on Friday with Father's Day and stuff like that. I just didn't get to it. But I wanted to get this in front of you so you would be aware that there's another challenge to the questions on the 4473. And I want to hear from you. And why should we be held accountable when people like Hunter Biden, who obviously lied about his drug use when he filled out and lied on a 4473, why should we accept that they'll go after you or me or Mr. Holden, but they didn't go after crackhead Biden?

When you have charges filed against you, oh, these are charges filed against you. You have charges, in fact, are you being investigated? Is the grand jury reviewing you right now for fill in the blank, whatever it is, and then they've generated paper on you. Are you guilty of a crime? So it was pretty reasonable that it became hand-to-hand combat and that three righteous individuals stepped up to subdue and stopped the individual who swore he was going to hurt somebody, maybe even kill somebody.

Well, if it went clean through, guys, and it had that much energy, where do you think that bullet went? You think it had a conversation after it left the guy's arm or his side and went, oh, that's enough. I'm going to just drop to the ground right here. No, enough energy went right through him. It is fascinating the blossom of energy and distance the energy can be applied with small arms fire right down to personal handguns. But they're not there now, are they?
Now the cops they don't mind too much because they'd rather arrest you or me because they figure we're easy pickins So they can pop us for small stuff and that's not a problem, but persnickety bad people like that
They are great for business because they create rotation, which is why the prosecutors and the cops are doing this so that they can boost the numbers to declare that they need a bigger police state so they can re-pump up the massive police state scam that they pumped up in the 90s that nobody's talking about that we didn't need, but was based on the whole FEMA agenda. You see what they're really trying to do? So they have to boost the numbers and when you shoot someone like that, the recidivism rate, you know that
What did they say? The number is ridiculously low. It's like for all the shoplifting in New York right now, it is, there's about 360 people, it's probably more, it's more like probably 380. The numbers are low, but still they do have the arrest numbers. But you got to figure there's taggers and other people side-bear with that. They might not have gotten on the list. But let's say comfortably 350.
They know that most of the shoplifting right now, a big shoplifting, is being done by only three, four hundred people. So if you put them in prison, what happens to their crime rate for shoplifting? And what happens to the overall crime rate? What happens to recidivism issues? You know, they get retarded and slowed down because, again, these characters are not going to get popped over and over and over again. Oh, and then let go because think about this.
Is shoplifting, for instance, oh what's that word? A felony. Well it is a felony, only if it's a certain amount. Well they didn't really change that, they just said they're not gonna prosecute up to a certain level, but the level that was originally on the books for a declaration of what it would traditionally be a higher crime, not a felony, but a higher crime, not an act of business,
But a higher crime would get your ass grabbed and put in jail. Now on the books, guess what? I guarantee it that if you were to look at the code for shoplifting right now, and they pop the person, and they let him go, and they don't prosecute him, they have stacked the criminal, the digital criminal code massively.
Now there's two things that can do with that. Number one, they're gonna use it down the road for this is why we need a bigger national police force. Well, if we had local police, oh, we got to get rid of all local police so we can have a national communist police force. Homeland Security is the interior police of the KGB, and that's where the pigs want to expand. The pigs, the excrement, the turds, the filth.

And everybody echo that hey guys, what's a fusion center? Where are the fusion centers in each region? How many fusion centers are there around the United States? And what part of Congress do the fusion centers report to and have to have accountability for? Oh, that's right. They don't. Well, then how do they legitimately operate under whose aegis?
These fusion centers as to think of that long Yeah, right here off of a the old for that here. Yeah. Okay. Well again We know that homeland succu-ride is tied into and joined at the hip and grossly in the classics a tanning pedo queer way They're boning each other behind the scenes as a mutual structure, but

Let me ask you something. What state got rid of sheriffs? And then you have to ask yourself why? I will give you a big hint. It's on the eastern side of the country. But it is fascinating again. What was the reason? Would that be New Jersey? No, I believe it was, oh, forgive me, not New Jersey. I don't remember ever, even growing up, I don't remember seeing sheriffs in New Jersey other than the guys that would come out from the court to serve papers.
Right. They've gone over the private individuals for that now. Those are bailiffs. Those are bailiffs without with with although they're extended through the sheriff's authority. Remember the bailiffs are still direct officers of the court. But they're officers of court through the construction of the the Shire the slash the sheriff's office. The East Coast well, you're closed.
But as far as I know, New Jersey's are still intact. Now, I could be wrong, you'd fight me in a microphone, only because there's so much garbage going on. But, throw another dart. Now, and I'm not ridiculing, guys, don't ever think I'm doing that. Throw another dart, because it's a little farther up the coast. Not much. Now, if you look, you can even find, if you do a quick search, you will find that you can even identify several stories, several articles without bragging. How about Massachusetts?
And if it's not Massachusetts, I'm going to say Connecticut because it's one of those three. Yeah, in fact, Connecticut and Delaware have been the primary targets. Delaware might be, it's either, okay, now here's the thing. I think both Delaware and Connecticut, but as far as which one was first is I believe, and I'm going to have to slap myself in the microphone if I can, if it jumps around the other way, but it was Connecticut, I believe first because it was targeted by, you know, New York. But New York, you know, here's the thing, New York Sheriff's are intact.

It's a situation where there's always something brewing but they focus a certain amount of energy and make extreme headroom in whatever way. Now none of those states are large. Vermont, Delaware, Connecticut, Massachusetts are all the tiny states. And so for that reason we're a lot easier at this point in time in this era to manipulate and have been for a while now. Technology being what it is. The interesting thing though is that they at least don't.

One of the things that I have mentioned is we've been going through some of the new technologies. We're going to get back to the subject around a minute here. But the latest batteries that the Feds using right now overseas in the military has started to use to a degree for the 123 batteries, the CR123As, actually is its own charger.
I don't know if any of you have seen these, but it's interesting that they're out there and they lighten up the load, but they're one-way bullets, really one-way bullets. I'll explain in a minute here. They actually have a C-type connector at the head on the side of the battery itself. Now these aren't new, but they're the latest wave of DOD slash also Fed type. We got a bunch of them from the source. And this is the model that they're using.
Well, I've got three different ones here. This particular one is one variant. But anyway, the other one, which is over the counter, which one do we want to do with it? Okay, let's do the smart tools. T-O-O-O-L. Oh, I know your mark. You're spelling it wrong. No. It's a plan. Words for them. Smart tools. Tools is the name of it.
And you come with four to a battery pack. They come with a cable, of course, for charging. It is a USB on one end. It has two C-type fixtures on the other two. So you can hook up two of these batteries at a time, which in many cases you need because a lot of your equipment does require two 123 batteries. However, here's one of the things I will point out. It tells you that this is a limited reloadable bit of ammunition. Okay.
Capacity 900 milliamp. That's cool. That's pretty reasonable. Voltage 3.7, expected. Charging voltage 5 volts. Now remember, these don't have a separate charger. So the little circuit on board is putting out 5 volts. That charges the 3.5 volt capacity battery. Okay? Cycle unit 120 or excuse me, 120. 1,200 times. Cycle use. What?
In other words, this is a limited bullet rechargeable. You might get a few more out of it, but I'd be willing to bet on board is a little part of the microcircuitry programs it for shutdown for a planned obsolescence, so you got to buy their junk again. So while the price is reasonable, it also is a finite item. It's actually almost semi-chuckable as it is, but let's see, full charge is
15 minutes to 2 hours or 15, it says 15-2 hours, the numeral 2 and then hours, with no space. So this is the one we're testing first. I'm giving these to the night vision crew. We want, well first of all, we're going to test them with another piece of equipment. I want to see what they, they seem a little overpowered. Is there something? It's a problem.
We're going to meter them too. But this is an interesting, again, onboard, easy to transport, plug in randomly with a multiple gang fixture of USB, hook it up to your computer to get it recharged, whatever you want to do, or to power supplies you have in the car, etc. But it's, again, an interesting idea.
The DOD, Donative Destruction, has had these in hand for a while without them generally making a lot of noise about them. And it depends on where you are on the planet as to whether or not you have them. Some people do, some don't. So again, just a heads up, this is another piece that might be useful. Now we're going to have to mark it, it's a monotonous thing to do, to map it, but you know why I'd like to accelerate that? If it actually shut down at 1,200 recharges, that tells you that this son of a bugger is programmed.
Because you can guess all you want, but you can be like some of your if with this being the case some of your batteries should be like 1162 then some of your batteries would be 1285 but if the stinking battery stops at 1200 that means that it's a soundboard circuit It's not that the technology has failed. You know the materials failed or anything. No, that's BS So heads up on these read what you've got when you put it up when you grab it put it in hand

And most military junk intentionally is proprietary so that they can keep the other side from using it, but also make sure that if they have to go to war against the peasant population as they perceive us, the unwashed of America, you know, the slaves, that supposedly we're not going to have the brains to figure out how to keep stuff in service, and so we'll run out. And it's a math formula they've counted on. Too many people watching too many movies, too many television programs, and a lot of video games.

Had a series of awards ceremonies. I was supposed to be there with the unit that I was with.

So we step out in front of the place and it was an old, it had old growth trees and there's a hill, a road that has a hill that goes past the front entrance and you're out of sight over, you know, over just a little bit. Then from our right comes this car with no windows. Windshield is out of it. Doesn't have a windshield. Looks like a car literally out of the road warrior. I'm not exaggerating in any way, shape or form. There are four or five guys in that car. They're all black. There's one guy shooting out the back of the window. There's another guy shooting from the side. What's he shooting at? Well, right behind him is another car with no windshield. It might have one window, I think, on the side that was rolled up. Maybe they couldn't get it down there or they hadn't broken it yet.
Both these cars, they were tired on the outside, but they were hammered under the hood and they were going for, they were going for gusto.
And as the car hit the hill and came off the ground a little bit, they're still wailing around and bullets are tagging the car behind it. But don't worry, the guys in the car behind it chasing the other one are busy wailing away with their pistols still popping on the ass into the other car. I think one was a 60s Chevy and the other one looked like it was probably, I just saw one the other day here at a car show, a 66 Chrysler.

The St. Louis, we've been through St. Louis, but we usually do it in such a way and we avoid it. But I tried not to and I now don't go through St. Louis because we got other opportunities. Tilly, I'm into filling a long, long, long, long, long, long time.
So since Philly's in the situation it's in and it sounds like as Dar pointed out, Camden, why are you going to Philadelphia? What is there you need to go there for? See now if you drop these and everybody starts in, don't do business. I will not go near Chicago. I don't even drive through around the bottom end of Chicago. Guys, if I were headed westbound, I am going to be going south and way below Chicago and completely around it and not barely touching the suburbs.
if even doing that. But you do not go to Chicago, you do not go to Detroit, you do not go to DC, you do not go to St. Louis, you do not go to Philly. Wherefore, because of their blindness, which blindness came from looking beyond the mark, they must needs fall.
Generally, a figurative expression such as the one Jacob uses in this text, Looking Beyond the Mark, comes from something that's common and familiar to the experience of those with whom it's used. Each language and each culture has similar idiomatic expressions. I've wondered what was actually in Jacob's mind as he wrote of Looking Beyond the Mark.
in describing a failing that was common to ancient Israel. As I have already indicated, Jacob's idiom brings to my mind the experiences of my early activities in certain sports events, when it was so important to stay within the mark. All of the strength and skill and effort a competitor could muster in the field events I have just described were of little value if he didn't stay within the circle.

They must have reveled in speculative and theoretical matters.

Their comprehension of and faith in the redeeming role of a true Messiah and the purpose of life became confused and lost to them. A study of Israel's history will confirm Jacob's allegations.
It seems to me that every generation faces its challenges with looking beyond the mark. The Apostle Paul worried about those whom he had helped to develop a testimony of Jesus Christ. Paul advised Titus to avoid foolish questions and contentions and strivings about the law, for they are unprofitable and vain. To Timothy, Paul wrote, preach the word.
Be instant in season, out of season. Reprove and rebuke. Exhort with all long suffering and doctrine. For the time will come when they will not endure sound doctrine. But after their own lusts shall they heap to themselves teachers having itching ears. And they shall turn away their ears from the truth and shall be turned unto fables.

As I have wondered how we might protect ourselves in the present day from going beyond the mark, I have resolved to do several things which I share with you this morning for whatever application you may wish to make of them in your own lives.

It is 13 February 2015. It is Friday evening. It is the last hour of the day and the week for the intelligence report, and that makes this Quartermaster's Corner. And I should preface by saying that I've been a little bit under the weather today.

First up, I wanted to comment on one thing before we moved on to other topics, and that is that there was a news item this week that there was a massive explosion in Donetsk, and apparently the explosion was violent enough to be seen by satellite.
and a mushroom cloud went up and the independent press was saying, well, we don't know but we're wondering whether a tactical nuke was used. Nobody's sure. My personal opinion is it probably was not. Mushroom cloud is characteristic of an extremely large heat source, not necessarily thermonuclear. If conventional artillery shelling
hit a chemical plant as seems to be the case and there was enough material stored up there that just went bang it could have caused that same effect. But the alternate press was scratching its head and looking for evidence and trying to figure out whether a tactical nuke was used in war. And the corporate press in the United States decided that the most important thing was that the Grammys occurred and Madonna has a nice butt.
Okay, well, I'm sure that Madonna spends a lot of hours every day in the gym working on that, but that's hardly news. If there's even a possibility that somebody used a tactical nuke, I would consider that a fairly important thing, and yet they instead choose to spend the airtime telling us that Madonna's behind is highly admirable.
Oh well, I guess that just sort of proves what we all know is that if you're looking for raw data and significant stuff, do not look to the corporate press. Ours used to be the gold standard compared to the other guys, but that's compared to, that's because, you know, Provenzas during the Cold War and the communist regime was pretty ridiculous. Ours looked good by comparison.

In this day and age, well actually with the Russians, they're notoriously thumpers anyway guys. They just love it being the biggest in the world. And because of that, through World War I, up until present day, they've always tried to press the limit on self-propelled and towed artillery, number one. Also, they do pack the biggest breach loading mortars on the planet, though those don't have the range necessary. They don't have to be safe.
But the other thing is small, you know, slash small at the strategic end or the upper end of the tactical inventory, which is FOG 7. Needless to say, the SCUDs, which are still in the inventories with pretty much every country that bought them.
including the Euro countries and the Middle Eastern countries, which as we know Syria has cuds. I think even Egypt has a small inventory and a couple of batteries left because they bought a bunch of them. Well the Russian approach back during the Cold War era was volume and mass over precision because they didn't have the precision available. Their computer technology lagged.
Their professionalism of the troops is marginal because they'd train them, cycle them out, and then mothball not only the personnel into the civil economy, but also the equipment. So they did a good thing in that they had given eras of equipment, mothballed waiting for the same era of draftees who could be brought back up again and thrown together with the same equipment they trained on.
But they didn't have a lot of career people and therefore the skill level involved in precisely dropping around exactly where he wanted it was not there. So they went with the approach saying, okay, if we have a second rate economy, what we're going to do is we're going to build area effects stuff. We're going to build Stalin organs and blanket an area with a rocket bombardment. We're going to use very, very heavy artillery.
larger blast radius, that kind of stuff. If you've got a second rate economy, that's not a bad approach. That's a fairly pragmatic decision to make. These particular weapons would be committed to the heavy weapons, the frog sevens, the scuds, all of the others. Or again, remember, West Ukraine is a prostitute to the Israelis right now.
Almost all the characters that have been moved in from outside the country are now into the money post and they are bleeding the Ukraine white. That's why they had this little fist fight that broke out earlier this week in their congress. My God, it sounds like America what it used to be, at least for the congress. So it's not really a traditional American chalalie brawl like we used to have in congress where everybody carried a walking stick.
But anyway, that was over the economic situation and also, Kurt wrote, well of course the addition was with the way they covered it, they said corruption. Well, what kind of corruption? Oh, in government. Well, what kind of corruption in government? Well, how about these cronies that are all kosher mafia coming in from outside one day they're foreign, the next day they've been given national citizenship and go right into these key positions to milk the money out of the country.
Now, the thing is that the Israelis also like to test weapons systems, and getting one on the ground and dumping one downrange would be right in line with the kind of trash they've done before, and we've done it too. Of course, so have the Russians. Go back to the one-shot knockout that took place, remember, with the Abrams tank in Iraq. Nobody ever explained in final evaluation what that was. Everybody suspects.
But the bottom line is, somebody got something new out there, got a chance to fire an Abrams tank in a real battlefield situation, and cut a hole clean through her, and did it in a dart fashion. In other words, the projectile in its solution went through the vehicle, through the hole of the vehicle, from the rear forward,
and literally cut through everything in its path and the diameter was only about the same size as a standard Sable Dart but it was not. In fact, they put a call out to the sciences for an evaluation and then they gave an entire public description of what transpired with the tank and why it was a one-shot kill. Now, the thing is that we're looking at something similar where, hey, someone gets to dump a tube down range and...
The best place to test is especially if it is one of the things that the Western Ukrainians said, not the Eastern Ukrainians who were the target, but the West Ukrainians said, oh, it was a chemical fascioliope. Yeah, I'm sure it was. That's a perfect target for covering whatever else you're doing. And again, big ordinance, of course. Well, again, you're talking telephone poles and sewer pipe and manhole size launchers as far as the platform goes.
So, when it gets down range, it's nice to be able to dispose of it, so to speak. But at least you get to see what its performance is. Does it mark on target? Like BK was saying, accuracy is always an issue. And of course, with modern laptop and technology, on your fingertips, there's no reason not to be able to do better. And perhaps probably the case is somebody was practicing, practicing, practicing. Well, there's that. On the other hand, if you're just hammering an entire city area, you don't need the precision.
You're just indiscriminately slaughtering people because you want to capture them alive so that you can enslave them as corpses.
