I'll tell you what. First of all, give everybody an overview. We're going to do the same thing we did last night. Right now Charles is in the middle of the next level of his court fight, but first, later foundation, Charles, a outspoken patriot and a marine. Give the background and bring everybody up to where we are. Okay, yes, Charles, he is a marine. He served eight years. And whenever he came home and during his service, there towards the end. And also whenever he got out of the service he was making Patriot videos, putting them up on YouTube. He was going around to tea party rallies, giving speeches. He was traveling around, basically helping people with firearm training, different things. He was very active in the Patriot community. He was approached and they asked him to stop and he basically told him to get bent and that he was going to continue doing what he believed in. At the same time this was going on now, he was going through a messy breakup with a wife who had been cheating on him and doing drugs and all kind of stuff. And this led to a custody dispute over his daughter. She came up with allegations that he had molested his seven-year-old daughter. And of course, you know, there was FBI involvement in the case. There was a weapons charge that was brought against him. It was actually a FBI sting that went very badly. He had purchased what he thought was supposed to have been a flare gun. Whenever he received it in the package it was actually a grenade launcher. The feds tried to bring him up on charges saying that he stole it and it was stolen even though he had the shipping paper where it had been shipped to him. They forgot that they already had the one who stole the grenade launcher in jail on the So anyway, they didn't block that case very badly and Charles wanted it. At that time they moved forward with these bogus molestation charges that is that's why they blocked his table. And it went to three trials. The first trial was a hung jury. The second trial was a mistrial because the prosecution had been sent in some sort of survey or something to the jurors. You know, that's not, they're not supposed to be in contact with the jurors at all. The third trial was basically a dog and pony show. It went horribly. The attorney that represented him in the trial, the third trial, was in without hope. And this guy didn't do anything. He just basically sat there and was a puppet in the constitution. He did not enter in things for the jury to see, which were very crucial to this case. The DNA evidence, the computer forensic analysis that was actually validated by OSPI, all of which clears Charles. DNA, computer forensics, school attendance records, diagrams of his home at the time, the jurors never saw this. The only thing that they basically allowed in that third trial was hearsay testimony from his wife. Currently, he has filed a direct appeal. He has filed a motion for post conviction application. All of that was denied right now. He has challenged the denial from the district court And that is actually sitting in the Oklahoma criminal court of appeals, I'm sorry, at the state level right now. And he had, I believe it's somewhere around six months to get a federal habeas appeal done. So we actually have found a very good, we feel dedicated attorney who can step in and help him at this point. He has been doing all of the legal stuff, pro se totally, researching it. Him, his mother, a few friends have been doing the leg work, looking up the cases that are cited and it's really in depth. I'm not really going to bore everybody with those details, but At this point, it is a little bit over his head, even though he is very intelligent. The federal appeals level is basically about procedures and all these weird things that if you don't go, that's why these people go to law school, so they can actually do this. navigating the system that should be cut and dry and only look at the merits of the case, which is how I feel, has gotten twisted to the point to where it is insane to even navigate the simplest detail of a case. They go out and try to recruit people. There's a whole bunch of other stories here that are going to be tied into this about how they tried to find and fabric them, especially in Oklahoma. Back in the Oklahoma City bombing took place. Remember, the governor was a former FBI agent, supposedly former, there is no such thing. There's a lot of dirty work that was covered over the years in Oklahoma and Kansas. I mean, most of these states got alphabet soup agencies. What they do, they go and look for the Fed wannabes or the disk rental, an IQ about the size of a shoe, and are usually crazy as loon. And they'll recruit them, and they're their boys, or they're their girls. And that's exactly what we've seen over and over again. We've covered this over the years. In this case, we're going farther. Okay, during the trial that ended up in the Hungary, which was the first trial. Now understand there had never been any kind of security at that courthouse before. However, in his trial, they not only had the metal detectors at the front door, they had metal detectors at his courtroom door. Now understand, across the hall there's one going on about the same thing, but all they were doing was collecting cell phones. Well, Charles is on the inside by the courtroom door. His sister is on the outside getting ready to go through. Two girls, one of these young ladies looked like they were probably in their mid-twenties, in jeans and t-shirts and, you know, nice but not dressy, went through with their purses and all the bells and whistles go off and they just keep trucking. Now, his sister on the outside hollers at him over the deputies. Who are they? How come they get to take their courses through and nobody checks them and they go off? Now, Charles in his infinite wisdom, standing by the courtroom door and he hollers back. Loud enough for everyone in the lobby to hear, oh don't worry about that sis, they're just undercover FBI agents. Those girls never showed up again. Come back, come back. I love, I love, that's probably one of the best things. Of all this, sometimes there are some highlights where some little digs are got in. But needless to say, those two little girls were never seen anywhere around this ever again. And I find that hilarious. But that's just, that gives you a little glimpse about Charles and the strength that he has. He's been through a lot. His family's been through a lot. The people closest to him have been through a lot. Charles is a fighter, you know, even now he sits there and he refuses to accept defeat. He is waiting for the day when his name is cleared and he can come back home and join everybody on the front lines again. He also said that he's going there Semper Fi when he called last night. He's repeating it. guys that makes all the difference in the world to get may say hi wave of mail people pay attention and realize that you're not alone so they have a tendency to you know shall we say be a little more cautious about doing stupid things or thinking they can get away with them in a vacuum so there's a number of reasons for having a good fog of and it creates another form of support also many of you out there listening legal work for those of you who can't in the know take pass on any information you can. It's a correspondence if you're a, you may or may not be able to respond, but if it's obviously something that's useful, they'll probably send you a letter back right away. And when you're working on administrative processes with the stuff that's going on, even behind the wire, you only get so much time in the law library. You typically, depending on the facility, either schedule it or again, your block is allowed to go. It varies depending on facility, state, county, hell, even within the same institutions or variations on the theme. So for that reason, again, when you are there, you have to focus, then you've got to come back to your personal office, you know, yourself. There in that is, if you're doing the typing yourself, or if you have somebody else pitching in and doing the typing, there's a whole economy behind the wire to help you guys that aren't typists. That's what they do. They actually have an income. They get bags of potato chips, they get soap, they get all kinds of cosmetics or things that they trade for their work. There is an economy inside every prison system. It's a way to get things to be paid for, copy costs. There's all kinds of things that pile up. Now let me give you an example. In most institutions in the state of Michigan, the prison system cannot charge an outrageous fee service because it provides the machinery. The prisoners pay for the copy machine. So the only cost is the paper and the technical wear on the machine. So for most legal facilities would be, you know, for instance, the law offices. or wall libraries for you. It would be about a nickel. In many places you've got scams running by the state, run by the state as a way to screw everybody, especially the prisoners. In Charles' case, you're looking at 25 cents a copy for each copy that needs to be done, and there are copies that need to be generated. Now, because of that, the most common trick is, well, you buy carbon paper. The system has an expanded commissary, but that variation state to state and prison to prison as we've covered many times on the air here over the decades. It varies depending on the scam they're running to try and retard you from getting your work done. There's two things that we have in the state. Here in Michigan, for instance, we could have programmable computer typers. It can only do 16 or 32 or so many pages depending upon what year they were bought. The cool thing about that is rather than carbon copies or photocopies, we could actually reproduce, you know, up to 16. 15 pages at a time, a duplicate in quadruplicate of everything, you know, there were quads of each page. And that means that we would have the copies made for the judge copy, the the prostitute copy, the courtesy copy for the court, along with our duplicates to go out to the family and the copies that we have to have on file with us for our progressive court work. And this is something that each economy is different. All these, there's no consistency in the system. There really isn't. Somebody will say, well here in Maine we do it this way. You're right, in Maine you do it that way. In Oklahoma, they do it in other Michigan, they do one trying to steal from you as much as they can if the state runs it. And it's like I've said many times. In the Michigan prison system, the prisoners buy the food, they actually run the commissary. And so you get everything it costs. You actually get it for a whole, which means you can actually get more for less money. county jails here in Michigan are run like a 7-Eleven store. It's like living at the 7-Eleven, then having to go to a vending machine for everything else, even if you're buying it over their commissary. It's outrageous, and three is seven times the cost of what you pay for it outside. Well, it's part of their scam to rip you off. Each system is different. But funding, what we're doing is sending the funding to Jan Dyer to make sure that she's able to regulate it. Funding is sent in in one lump. That's a way to do it. Actually. It's a good way to do it here remember if you're gonna send in support or in funds with mom take care of this and Assist focus on what he's doing But if there's something that you have that is a useful or something that can be done to help out Guys, they can coordinate right away. They're gonna be visiting. They're gonna be able to you know again call it does I guess the last this this Charles regular basis or you know again our phone calls are great. Yes, yes he does. We talk to him almost daily and that is we have to keep money on our phones for him to call in and we pay three dollars and fifty two cents per phone call and the phone calls only last 15 minutes. Yep, okay see that's and strangely enough we did a survey on that and sued the state of Michigan. Most of the phone systems are run out of your state. Most of the prison phone exchange systems, a lot of people listening go, oh Mark, I know in the state of Michigan it was $11.50. Initially it was almost $20 per call. This was a scam they started running about nine, ten years ago in the system across the country and it was another way to milk money out of the families of prisoners. The good thing is, although still, it's a crazy price, $3 a minute, who the hell is paying that anymore anywhere? Now guys, because of that, you get really good at focusing on what you're saying when you call for everybody out there listening. Everybody can tag team and do different work from different angles. then that is something that we could look to. Somebody out there might be retired and be a lawyer who really hates this. A lot of people became lawyers after Vietnam and at the end of Vietnam because they were veterans. Well, that's 30, 40 years ago, kids. We don't think about it, but they're still experienced lawyers. They got their end, they got to be a lawyer not because they wanted to be a lawyer. Let's do a bit of a start over who we're talking about, where he is, why he's there, as we did in the beginning here for the listeners that are just joining us here this morning so that they are not jumping in in the middle of a conversation. Okay, Charles is very active in the Patriot community. He made a lot of YouTube videos about things going on in the government, the tyranny that we were facing, encouraging people to know the Constitution, getting groups, get active. He would go and give speeches at tea party rallies. around and help different people get different groups up and going. During all this he was going through a horrible break up with his wife at the time. That put him in a pretty nasty custody dispute over his daughter. So not only was he battling the harassment from different alphabet agencies wanting to see his activities, but then she came forward with these bogus sexual abuse allegations. And he beat a federal weapons case over his thought he was supposed to have purchased a flare gun. Whenever it was shipped to him, come to find out it was an illegal grenade launcher. They had the shipping package there and everything and they tried to say that he stole it. Well, they forgot that they had already had this actual person who had stole the thing in custody previously. So, you know, he was able to beat that case and then at that time they moved forward with the sexual abuse allegations. It went to three trials. The first trial was a hung jury. The second trial was a mistrial. The prosecution had actually been in contact with the jurors through some sort of survey or something. And then the third trial, none of the exculpatory evidence that cleared him was presented to the jury. The DNA evidence that proved he was innocent, the computer forensic analysis of his wife's computer, that showed various searches of how to win custody disputes, what happens if you make false sexual abuse allegations. There were several pornographic images that were on there and as well as... This was on her computer. It was on her computer and he had absolutely no access to her computer whatsoever. And I think it's also important to point out that during his daughter's testimony, not only does she keep saying, I don't remember, I can't remember how the story goes, but she actually described the bedroom as being white. And Charles' bedroom was brown and green. He didn't own anything white. The white bedroom was actually in a pornographic video that was on her mother's computer. And to this day, it has not been investigated. Nobody has investigated this woman wanting to know how she was describing that. Which is very troubling for me as a mother because I don't really understand why nobody is looking at this going, well, how is this child describing an act in a pornographic video? in the room itself in a pornographic video. There was also school attendance records, all kinds of evidence that the jury never got to see. It was basically just outrageous from both sides of the aisle. The prosecutor, when you go back through all of the hearings and the trials and stuff, There's over 30 instances where the wife, this woman, perjured herself over 30 times. The district attorney knowingly allowed her to get up there and lie on the stand. During the charge of direct appeal, post-conviction application right now, It's sitting with OCCA, which is the Oklahoma Court of Criminal Appeals, and he's also gearing up with the help of an attorney that has just recently been found to come in and help guide him through the federal sales process. That's where we're sitting right now. This fight for his freedom is so intense right now that every day, it's like those of us who are here and we're living this day to day, our stomach's staying locked. It's like something new on a daily basis. Yeah, I know that a lot of your listeners are computer people. I'm not the biggest computer person in the world. I work at home on the computer. number retired RN thought I would be retired but I'm not I'm still work because of this I just say in court that all of this evidence on her consecutive office was without a power source so like he would know before these charges were filed even that they were going to be filed and that he would need all of this on her computer well later they tried to say well he put it on there well he didn't have access to her computer for many many many many months prior to all of this happening and when it went to the to the OSBI, Oklahoma State Bureau of Investigation for this forensic investigation analysis whatever you want to call it they have in the report no power they had to go find a power source. It was sitting in the evidence room in the basement by the sheriff's office and he was supposed to have been able to access it. Well, I don't know how without a power source you could access a computer, but that's one of the things they brought up in court. During the first trial when they did present some of this evidence. Typically what they'll try to do is, again, the tutor's job is to lie. We've gone over again, we've covered so many cases, it's sickening. But there was one other thing here real quick, and we're gonna keep you around for the next hour here, and keep you at least, you know, as long as we can here. One other thing real quick, they went to one of the relatives to try and whip up more stuff, didn't they? And she came back, you know, she told you what actually transpired. Everybody has that story real quick. Oh, they pulled our granddaughter in Tennessee into the FBI office out in Tennessee. FBI agent here, Ken Western, had called out there and told them to do this. So of course they did. And told her that they had it on good authority. She had been molested by Charles when she was little. But if you don't remember it, don't worry about it. You were asleep. Charles is two years older to Oklahoma when she was five and they hadn't been together. And this happened when she was 27. the agent and she said I know who your good authority is it's his ex-wife and she's crazier than batshit. Got up and left the office. Right. And that's just one of the things that Charles and his family had to deal with. They also had the same agent, Ken Western and another one, Jean Poole. They were calling everybody in town, the local law enforcement, people that were tied to Charles to the Patriot community, friends of the family, friends of Charles. Even out of state, all over the country, everybody that knew the Dyers, they were calling saying the DNA was going to convict him. When in fact, when the DNA come back, it cleared him. And then you've got the FBI pulling, putting all these ideas in Sheriff Wayne McKinney's head that Charles is a domestic terrorist and he's a threat and he wants to harm people and this and that. Sheriff Wayne McKinney told Diane Sawyer Mainstream media. Oh, well, Charles is the Timothy McVay-like subject. And remember that the whole idea behind us is to whip the image up, or to, you know, to again create the issue behind the scenes. We've pointed this out time and again. The FBI is a drama queen. Their job is to go all, like you just described, go everywhere they can, paint the pool and minister. If you're dealing with a Fed, with a liar. You're dealing with a fed, how can you tell when they're lying? It's when their lips are... They are nothing but a political creature with a political agenda. That is a fool. It's interesting that these feds especially love it when a leftist is... Especially a raving, screaming communist. And they love following the orders to burn down churches, women and kids, people in the church. Oh, wait a minute, I'm talking about Waco, that's right, remember? It's that same FBI. And they're kind of notorious across the board. It's just that the assumption is, well, we just saw this here. The active agency and they all take us and they all... Life was threatened at the courthouse in front of me and they knew who I was. I would get him in with particulars of his case out and see how long he lasted. Well, it wasn't long after that, after they had taken his girlfriend and for it. I mean it was a big mess. Anyway they did burn his house down or somebody burned his house down. People have been convicted of it that I don't believe had anything to do with it myself. We've been through a lot.
