an activist that he thinks a judge should make and create law and take a major role in the legislative process. When Elena Kagan was asked her views on using foreign or international law to interpret our Constitution and laws, she replied that she approves using foreign law arguments. That's not a good sign. The U.S. Constitution states that our judges shall be bound by the Constitution and the laws of the United States which shall be made in pursuance thereof. Federal law requires all educational institutions receiving federal funds to present an educational program on the U.S. Constitution every Constitution Day, September 17th. Kagan thumped her nose at Constitution Day in 2007 by hiring a transnationalist on the Harvard faculty, Noah Feldman, and featuring him for two days of speeches. Transnationalists are lawyers who advocate integrating foreign and international law into interpretation of the U.S. Constitution and laws. The left is counting on Kagan to reassert the discredited doctrine called the Living Constitution and to play a big role to get the Supreme Court to uphold Obama's transformation of our exceptional private enterprise system to a socialist economy. That Y2K would happen only if through their demographics they firmed that everybody was in catatonic brain fart and they wouldn't have a clue when they hit the switch. That song, of course, if you were to listen to that, if I were to throw that song out right now, except for the old, you know, hey, by the way, the guys who were listening to music in the 80s, the old guys from the 80s that were younger than I am, they're now kind of old fogeys too, because that was like 20 years ago, so that put their 40s. Can I say that? Yes, I did. Oh, let's rub that in. That's right, time waits for no one, by the way. So back in 1984, Al Stewart wrote this song, Rumors of War, and when you read the lyrics, if you just look at the lyrics on the album, remember the original albums, records, of course, and even original and new CD, well, guess what? Well, man, that's like songs from right now, man. That song is from right now. No, that song is like from the end. They actually wrote that song just at the end of the 70s depression like 80-81. It went into the album in 84. Actually, you know, album was cut in 83 and you know, dumped in 84. So anyway, the point is that this is totally new then. No, it's not. It's like they just simply pull that 33-member CD. They pull that record off the shelf and they plug it in and they replay it thinking that everybody's, you know, not gonna pay attention. This is why libraries are This is why librarians make sure that music disappears. This is why the music industry can't allow played. I was thinking about this looking just at the collection I have, which is probably, and not exaggerating, probably close to 10,000 CDs, god knows how many. And I mean, we're not talking brand new stuff, guys. We're talking CDs. We're talking going back to when CDs first came out. And I don't use external buy this. This is all stuff everybody goes and it gets brain dead and they start throwing away. And the more I go through it, because I pop music, and I'll be running two or three machines at the same time, and I'm popping music in and intentionally going through it and trying to find stuff just like that so that we can play it on the air for you. And you can go, hmm, well that sounds like it's right now. That's right now. Well, if you recognize Al Stewart, you'll read, everybody knows, no, that's Al Stewart. In fact, it's almost a pretty young Al Stewart. If you're 84, that's almost 30 years old. He's getting up there too guys. He's you know, with the same age we are. If you're those you that are born... Well man, like whoa, we're getting old. But anyway, it's interesting, especially the stuff, and this is why, what I mentioned, you know, years ago, is there's a window niche that was absolutely in the no play category. Really obvious that it's been a lot now because you see, you have venues that came into the 70s that, you know, were very unique. And they parallel each other. One was to try and divert and just gave everybody a different lala. And that was disco. Now, don't laugh, because disco has come and gone three times already. If you don't know that, then pay attention to the music industry. And disco disco, we're not talking only with another name. Disco made at least three different wave comebacks, especially in the music combo industry, along with circus. It still has... it's niche because it's, you know, again, really all disco is additional dancing music or, you know, mindless dancing music where you're not supposed to think, okay, just blah, blah, blah, you know, blah, blah, burn calories and you feel better about it after you've got a clue what you did. From the other end, though, is no play category from 1970 to 1973-74. And overlapping with that are the artists from that period who still did the message on a wide scale. Now, most of it started out, and most of the artists started out, by the way, as underground artists. What did they parallel with? Does everybody remember this? I'm jogging memories from people who've been so busy having to make a life and go to hours a day and run to the car and run to the job and run to the car again and run home that we kind of, you know, the library gets bigger in our minds, so we kind of throw those books back in the lower shelf or back in the back shelf, right? What came about? What is it that helped to really boost a resistance message music? Now there's a bunch of bands, you've got one of the Kinks which overlap because they didn't start out and mess around and bop, really making a headway. Well it was FM Radio guys. Micro FM Miller Radio, under UCLA, Underground Radio at the University of Michigan. Underground Radio at Michigan State University, Underground Radio at Notre Dame. underground radio here on the east coast right here at bubba dot a underground fm radio fm radio did not exist it was not brought martial industry always remember that fm radio was not brought into existence nor did it become popular because of any of the bubblegum india remember the term payola you're you might be a jockey memory on that one because they're even movies about this for the bimino there been books written about it always mentioned in books from the Paola. Paola, the term comes because, well, if you didn't pay to get certain things done, you just didn't get your music played. It happened in overlapping tiers. Well, because there was no way to break into getting your message out. And a bunch of these radio geeks from the Vietnam War started to come back, and they'd had radio stations overseas out in the middle of BFE. Good mum! Well, that's the army version, okay? was allowed to be here and here's the other part of the story on that the reason they left that you know they they let him get away is because they have the army and the government had to counter what was happening with hi dudes this is frank out here with the 27th infantry man i'm out here we're in the field chow bong by a bong song uh... pow well you know you know to poi middle of nowhere today I'm bong song and I'm set up broadcasting usual time. It's 9am over here in a hot and muggy place. And that's a let the video change with the military broadcasts because they were losing it. Why? Well because while the guys were overseas over there in Vietnam, and let's not forget the land East Asia, that they were running into stuff they'd never seen in really quantity before or for the price it was and that was electronic technology. So Transistor had taken hold in the industry by that time and now Compact Portable Technology was readily available. Filter real, not cassette, but the tape player meant that people were making copies of the latest music. Frank did over in St. Louis and played a live band and Lloyd Frank, that's right, Frank Zepperman. Of course it wouldn't be Frank Zepperman. Frank Zepperman was that young, he was doing stuff then, but he'd be really, really young. Anyway, the point is that all these musicians, their music was being sent over there and it's like, have you heard this stuff, man? And it was like, no way, yes way, check it out. So then these radio geeks, who were RO's, radio operators, had equipment, knew how to tweak it, and everybody knew that if they tuned in their little transistor radios, other equipment that they had, that they could be listening to something other than Good Morning Vietnam. They were listening to other guys who were just little micro FM stations. and the technology caught up they got came back here and everybody taught everybody about the wonders of f m because it was so clean there was no fading there was no crackling and it sounded cool you got beautiful with the technology and synthesizer technology coming up sound quality chino start take a death a m of course initially didn't really take a look at them for instance uh... f m radio's have little and that you know actually create f m you had an air radio we had a box of the radio geek did About the size of four exesigurates laid by side, you know, two and two. And what happened is people started mounting the car and they were listening to the Moody Blues, man. If you were listening to an original Moody Blues album without the cut, the songs, the Moody Blues. And like I mentioned this on the air before, a good DJ used to be able to, the cool DJ, man, you want to hire Fred, man. Why do you want to hire Fred, man? He's kind of stupid. He's not stupid man, you ever listen to him when he does his DJ work man? Man, he can go to Pink Floyd man and hit the button man, he's right there man, dark side in the moon. It sounds like he's got a magic finger man. Jeff Rotol man, he can hit the songs without, I mean I don't know how he does it. He finds his place on the album, he drops the needle and it's like the song, the band's right there. You don't have any, there's no noise and stuff, I don't know what he does, he's a magic finger man. You can get everybody into, normally you'd like wear cheap but then you put something on it and tell everybody it's so important because the fashion super peasant clothing some of them having to actually send it to a sweatshop and make something unique they could just simply crank the same thing out but put a little button on it that cost them a whole lot less to stitch much you need that because it's got the eyes odd or whatever symbols you know I mean oh and then eventually they didn't bother stitching it then he just looks great it and go oh if you don't have an Adidas check on your Chinese made t-shirt you're a Adidas isn't this is like really Yeah, yeah, but it's really important.
