and your daughters visit doctors so their children won't be born. Your leaders send artillery and guns to foreign shores and send your sons to slaughter fighting other people's wars. Now, it is the second hour. We've got a whole string of callers here. I've been really patient. We've got Dave. Dave, I want you to go ahead. Let's go top to bottom. And again, Spike's listening right now. We're going to be trying to get everybody together on this. But go ahead. Dave, you there? Yes, sir. Oh, right. We got you. Now, you go right ahead and go step by step. Let's do this on the air. We're helping more than Spike. Got a lot of other people listening, too. I was hoping we'd get to do this sometime. And let's go through this.
First of all, Spike has made several mistakes. Let's point out the mistakes and then we have to be able to go back and correct this makes. One, you are to return the citation within 72 hours of receipt of it.
If you keep it more than 10 days, on 10 days, it is automatically presumed that you have accepted the contract and have therefore entered. Remember, you are in Code and Rule pleading courts. These are not common law courts. They are not Roman civil law courts. They are Babylonian whore courts, better known as Code and Rule pleading courts. There, a contract is always presumed if you keep it in hand.
That's how the IRS plays its games. It sends you a notice, you throw notice in basket, and they move against you because you kept it more than 10 days. So that has to be overcome by doing a return of it, and it has to be returned usually accepted for value, written across the citation in a red felt pen, accepted for value, returned for cause, under lawful protest, without recourse.
That must be written in red ink on the face and the back of the citation and returned to the officers certified mail return receipt. However, another document also needs to accompany that. A document called the Waiver of Immunity. All officers, judges, prosecutors, professional witnesses, clerks, stenographers, and other parties who are of the court were granted by the United States Supreme Court the right to
perjure themselves against you for the benefit of the profit of the state in any case and that has been the law since 1983. So you have to send a waiver of immunity to the officer and within 10 days he has to sign that. Failing to sign that then you're able to petition the court to dismiss for lack of reliable witness.
However, it is also good to file a waiver of immunity against the judge and the prosecutor, and remembering both the prosecutor and the judge of oath of office at the county clerk's office. It is absolutely imperative that you get a certified copy of both the prosecutor and the judge's oath of office, and they need to be filed into the case part of the record.
Then, as Mark was talking about, the bill of particulars or the more definitive statement of going through the facts and listing out what each of the laws and the principles are, it is found in Federal Rule 12, is where you may find this, under the Federal Civil Judicial Procedures and Rules.
Each state has a similar rule to it, and you'd have to look up and see what your state rule is under federal. The rights are listed in Rule 12B. Under Rule 12E is the more definitive or the Bill of Particulars, the statement is there. Then in Rule 12F of the federal rule is the motion to strike. That's the real killer.
And if you'll ever watch a prosecutor, they over and over will always, every time you try to do anything, their first response is, is a motion to strike, to have your motion dismissed, thrown out, and leave you with no defense whatsoever. And it's doing them before they do you. Now, you can only file one notice or one motion at a time.
Only the last one counts. If you file five or six motions, petitions at the same time, all the rest of them will be totally disregarded or ignored by the court. So we have learned to be able to put multiple actions or parts of the Rule 12 into one motion and move forward on it in that procedure. It's quite complicated. However, also there are three things that you need to do
Once they start a procedure against you to protect yourself from going to jail one is you enter into a security agreement? You record a UCC one form with a Secretary of State based on the security agreement? Three you get a third party to post a bond in $21 worth of silver coin now They cannot move against you in any
spurious action to throw you in jail for any mistakes or whatever you have made. Also, entering a plea of not guilty is a dumb move, but usually you are forced or terrorized or intimidated or under the threat of arrest. They force you into such pleas. You cannot prove anything that is a negative. The only plea you should have entered was a plea of innocence.
But they normally will not allow that because they want to put you at a disadvantage. You can't disprove a negative. You can only disprove that which is it, and therefore you've gone playing in absolute circles at an extreme disadvantage. The best plea is the plea at Barr, which is what your case really was, Spike, is a plea at Barr because they are stopped by their own rules and regulations of the state.
And they have no case, but you didn't enter that plea, so they've sucked you now into the little game of playing Russian roulette. Usually the plea you enter would be a non-assumptive if you were forced to plea, but in your case you had the plea in bar because the law is in your favor.
I don't know if I covered much of it there, Mark. It's so much to cover. Well, the biggest problem here again is it's not so much in any intentional error, but that is if it was a lesser of two weebles, as we know, and that's always what's offered is two evils, weebles. Either choice is bad choice for the people. Right, but the thing is that we're looking at it from a working knowledge. Typically people will choose the not guilty, but the not guilty, but the whole point is that we can proceed to
whatever it is that's been done, and dependent upon the different arguments that are presented for, again, the bill of particulars to try and, first of all, convince them. And this is really what we're trying to do, is show them that by filing the bill, what you're doing is showing them you're completely cognizant of the actual guidelines that exist. In other words, that their interpretation or their restrictions or the informing
that you have them in hand, that you're presenting them to the judge, the judge is now working in a frivolous manner to proceed, so is the prostitute, but the prostitute is a money gubber, even more so than the judges are. And they're going to proceed simply because they figure its points and they hate the idea of having something where they lose on record, where they're defeated, especially in a pro se case. Now they will still, in many cases, agree that, well, yeah, we better throw
up in the air because if it's demonstrated time and again that many other people, in fact you don't know how many cases have come before this court in particular, or it's actually been thrown out. The sad part about it is all of the court records, all the court cases are computerized now. They have been for decades and they've been also entering them into the record base.
So, you can actually identify what percentage of cases have been brought forward under the code for that citation, that type of citation, and get not only a survey for that court that you're in, but for all of the courts of the state of Indiana, or all of the courts of the state of Michigan. And I'll give you an example. I had one particular case against myself, and I am the only case in the history of the state of Michigan of its type.
Now, how did we know this? And they fought tooth and nail not to acknowledge this. So you've got to remember, this is what I've said many times on the air. On the one hand, they've got cameras, they've got computers. If they want to use them for their purposes, oh, absolutely, no matter what, everything is accessible and everything is submittable. When you turn around and demand information from that database, they will be especially when it's beneficial to you or it demonstrates malfeasance on their part.
they will do everything that they possibly can to resist it. And we sent, I spent, I think was it four different sessions in court as a sidebar just dealing with accessing the database. And again, eventually we got it. And it turned out as we, as I said, I was the only case of its type in the history of the state of Michigan to that date. And I'm abbreviating it's much more involved in that. As far as what the case was and all that, I said, we don't need to do that. But the point is,
You may already have had, you're not a precedent-setting case, they're just assuming that most people aren't going to look to see exactly how this has been dealt with in the past, or even how that court has dealt with in the past. You have an officer in the field who is performing in an arbitrary fashion, who is, my biggest concern is it's basically just creative revenue nowadays. It has nothing to do with justice. The judge is also done. The judge stepped over the line by not dismissing. He should have.
he should have performed in the first place.

And the most important thing is to keep hammering and setting a precedent by showing that the bill of particulars demonstrates authority or the lack of authority on the part of the court in this case. Anyway, we're going to go to break for a second. We'll be back in about three minutes.

prior to going into a courtroom prior to arraignment they've already sucked him into arraignment now he has to be able to cover however the law is in disguise favor spike has the advantage because he already has a lot he's presented the law and both the prosecutor and the judge have stepped over the bounds knowing that the law is contrary and they have proceeded to to damage him
Now he's in a position where he can actually bring a presentment against them as well and seek damages for derelict of duty. But that's a whole other ball game in itself.
I think most important is just to neutralize, he just wants to neutralize the ticket and stop the process. That's his first concern. Yeah, and it should have been done when he was in that courtroom and the judge didn't do it. And as you continually said, they're all desperate for money, so they're looking for anything they can steal no matter how they can steal it. They don't care what the law is. And it's happening all over the nation. It weren't for the fact that we've been seeing this as a hyper-accelerate with every month over the last six to eight months.
it has gotten progressively worse across the state of Michigan. We've heard about this from all points of the compass in every state of the union. Here's why, Mark. I went to the grocery store last Thursday and bought a cartload of groceries like I normally do the first of the month. I had intentions of planning of spending maybe 150. Normally I spent about 120. I spent 200
Everything I purchased was on sale except for two items. I did not even purchase any hamburger or a steak or anything like that or any meat because there wasn't enough money to go to buy any more groceries. And the strange thing is that night on the news when I watched
The news said that all the groceries across the area here have increased by 6 to 16 percent on the average. Milk has gone up 26 percent and the eggs have gone up 42 percent in the last month. A combination of A, well cost, as we know cost and transport is not the least.
But also devaluation of the currency is going to proceed to create this type of an effect upon people's wallets. You are not seeing an increase in wages that is even going to come close to matching the devaluation of the currency. That the money is going down, down, down, so these clowns are getting more and more desperate because they need more and more and more because it's worth less, less and less to keep their machine running so they got to keep stealing more. They're basically spoiled two-year-old socialists.
The other thing I wanted to mention before I leave here that I thought was interesting, while I was shopping last week, I had the opportunity of bumping into the local recruiter for the United States Army. He was wearing some interesting cammies I had never seen before. Sort of tan and bluish-gray checkers. It's the digital, yes. That's the new digital. Doesn't blend in with anything.
pockets on the arms and in the pockets on the jacket were at angles is totally neat and I was joking about his brace as well how does it feel to wear that cheap Chinese knock-off parade oh no my parade made in the USA well what about the uniform he says that's us too he says but yeah he says you're right I know that a lot of the gotten soldiers are wearing Chinese clothes now and he says I don't like it I says
I says, what ought to make you more comfortable is that the ammunition you're shooting and your M16s made in China too. And he says, yeah, you're right about that. I said, suppose they don't decide to ship any next month and you're in a battlefield and you got to wait 30 days for the ammunition to arrive. How does that make you feel? Yeah. Do you think our private contractors from overseas are going to give squat care about whether or not the true soldier on the battlefield, if he's ours, runs out of ammo?
I don't think so. You're not too worried about that. And the other thing I noticed about this recruiter that was different, I kept asking him where his rank was, and he finally showed me. The army is getting desperate. This guy was a private first. Well, a motivated young man nonetheless, he was told as Bill the Galactic Hero, as long as he gets somebody else to go in his stead, everything will be fine. They're desperate when they don't have a sergeant sitting at the recruiting desk.

That is an option, and it's another direction that's been proposed by people around the country because judges can be impeached just as any other elected office can be, or even if it's an assigned office. You can approach the Congress on the issue, the state legislature, and act accordingly. In fact, it could also be done at the federal level with the other judges. And these are options that have been available. They try to imply that somehow they're untouchable and they're not. There are specific administrative processes that have always been in place.
There has to be. There has to be a relief, you know, an unjust activity. They can't just be plugged in and, you know, of course, Emperor for Life, they'd like that for other other karakin' systems. Mark, one more thing. I've been trying to find a book all weekend and I, it's out of print. They don't print anymore. I'm looking for a book called Anderson's book on sheriff. Does that want to PDF it? You know, again, I will, I'll hold on here just a second. I put George's number away here, but I'm going to tell you real quick.

Well again, by Michigan law, what we did is went into a sidebar that usually set up a little table outside the courtroom and you can come up and plead to save the court time and of course so that they can make more money faster. And what was interesting as we came up, we already of course had the information coached to the different people who came into the sidebar outside the court.
And what was interesting is here were all these lawyers standing with all their clients. We stepped forward, we had a copy of the actual MCL, everything right there in place. The person looked at it, then tried it. Well, we can make a deal. How much are you willing to pay? Nothing. The citation is invalid. Nine, nine.
of the catatonic brain part for a second and then they both got up and left the table real quick and ran back into the courtroom and they came back out and they, of course, with a document, you know, the citation dismissed and neutralized, you know, and all of a sudden all these lawyers, including one who had just been in front of us, with the exact same case, looked at the citation that he had in hand
realized that what we were talking about was correct and immediately reentered an argument to rescind. Because of course here he's got a person, the person, the kid that was standing with him had paid big money to have that lawyer standing there so that he could make a plea. After doing his job, he helped to put in place as a member of the bar, he would have known that he didn't have to plea in any way, shape, or form. There wasn't any citation in existence where there was no witnessing statement.

Last but not least, we worry about getting into the courtroom to actually fight any kind of court battle with regard to the process, the charge as they would call it when they've entered it and they've moved it in through the, and again, the Irwin Rommel School of Law. Remember this, court is the battlefield, the judge, an enemy general, the prosecutor, an enemy officer, your lawyer, especially if he's a public pretender, an enemy spy. All that they've set up is an enemy course. You're doing just fine. If you think that somehow they're on your side, you made a mistake. They're all in the business together. Now, how well you go, how well that works is by first understanding the type of battlefield you're on. Anyway, other stuff going on. We do have the next party on the beach on the 29th, getting advanced warning on that because we have a lot of work to do. I won't say so much confusion, but there's always so many things going on. There are a number of things that we need to accomplish by the beginning of next year.
We have primaries coming up. We're also looking at with all these militia formations that are growing right now and this has been a big problem. I'm going to say I told you so. People, we're not going to be able to go around and micromanage. You're all going to have to deal with this yourself and that means person to person, again the basic building blocks, fire team and squad. Fire team and squad. Four squads, make up a platoon.
Four platoons make up a company. Three infantry, one specialized. And when I say specialized, that can be combat engineer, that can be a weapons section, slash weapons platoon, whatever. But remember, basically, platoons make up a company. So you're looking at about 120 men in women, of course, depending on how your formations are organized. But we're having to look at getting these things done and out of the way, equipping, uni-forming, outfitting in general,
You guys have to decide the process there too. We know the different forces have committed to different resources and we understand why. We do have mechanized, we have artillery, we have aviation, we have air defense, we have air assault. There's a number of different formations out there. We virtually run the gambit as a combined arms paraconventional force. Act accordingly. Make sure that again your fuel reserves are in place. Make sure your equipment is in order.
If you're Minutemen slash militia, you're supposed to be able to grab your equipment, turn, and run. In other words, move to the vehicles, get out on the road, or cross country, and move to your mobilization point for action. You have to, again, look at your gear, take a look at your material. Again, don't borrow stuff off your gear. This is one of the most common mistake made, and this is cold weather where it can hurt. You leave your spare gloves and all of your other equipment packed where it's supposed to be. If you need more, guess what? Go on and buy more.
Don't start picking from your gear. Go to the dollar store. Pick your other stuff up for using every day for beating the snot out of or getting greasy on the car. That's what the dollar stores are for. I was talking to somebody about this earlier today. China Mart's not our first best choice, but you know what? Where it counts is with all this throwaway stuff. Use the throwaway stuff where it's suited. Save your best gear for when it's really, really going to count.
and we'll use the Chinese knockoff stuff or the Chinese junk that they're offering in the dollar store as a bridge to get us past some of these bumps in the road. That's how it's going to work. And remember again, many hands make the light work, so work together. The advantage of purchasing in bulk, group purchases whenever possible. Remember, when somebody asks any questions, baffle them with BS. Well, what are you buying all this for? Oh, we've got Boy Scouts, Cub Scouts, you've got Girl Scouts, Brownies.
Church socials, take your pick. You know what, if you've got to snoop, you've got to feed the snoop BS. In other words, keep them in the dark and feed them BS just like any other mushroom. It's all they deserve. Otherwise, we are getting close to the top of the hour. It has been a busy Monday. Got a lot accomplished. And by the way, I got a brag in the other room, for those of you who are wondering, a lot of people were, you know, one of our burners. We, of course, use a corn burner to heat the house. It's running right now in the other room.
Our cost for heating most of the house at a comfortable temperature is about one, little under one bushel of corn per day. So basically we're looking at, and again, any grade of corn just doesn't have to be anything great. Feed corn, we're not talking people eat or stuff, we're talking, this is a great way to get rid of that genetically engineered garbage that's being made.
Well, corn burners are available all across the country. Look into them. You can go small or you can actually go with furnace type systems that heat the whole house. Either way, right now we're snugly warm here and we're using both wood and we're using the corn burners just fine. You need to look at them yourself. As always, God bless the Republic.
